CASSELBERRY CITY COMMISSION <br />Minutes of February 9, 2015 — Regular Meeting <br />Page 9 of 14 <br />12. OTHER ITEMS <br />A. Request for Reduction of a Code Enforcement Lien — 852 Turtle Mound Dr <br />Staff Presentation: Development Services Manager Chad Lingenfelter gave a brief overview of the request <br />stating that the violation in this case was for a roof that had fallen into major disrepair and the violation had not <br />been corrected from the time of the violation was first observed in 2008 until final inspection in December of <br />2014. He stated that the matter had been heard by the City's Special Magistrate, and the reduction in lien was <br />recommended by staff and the Special Magistrate. He added that the applicant had already paid $2,900.00 <br />related to administrative fees accrued in handling the code enforcement matter, and the roof was now repaired <br />and had passed all the required inspections as of December of 2014. In response to questions from the <br />Commission, Mr. Lingenfelter advised he did not believe the reduction would set a precedent that would cause <br />any future problems, as it was an unusual occurrence for a violation to have lingered for such a long period of <br />time. <br />Mr. Daniel Osborne, the property owner at 852 Turtle Mound Drive, expressed appreciation to the City for <br />working with him to resolve the issue. He advised there had been a number of extreme extenuating <br />circumstances that had prevented him from remedying the situation earlier; however, those issues had been <br />resolved and the roof was now completely repaired. In response to questions from the Commission, Mr. <br />Osborne advised that there were no other issues with the home. <br />Budget Impact: Revenue has been budgeted in FY 2015 for Code Enforcement lien payments in the <br />General Fund Violations of Local Ordinances /Code Enforcement revenue account #001 - 0000 - 354.20 -00. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />the Special Magistrate's recommendation to reduce the lien from $201,500 to $1,000, to be paid within 60 <br />days. <br />MOTION: Commissioner Meadows moved to reduce the lien for Case No. CE -08 -03646 <br />from $201,500.00 to $1,000.00, to be paid within 60 days or the fine amount will <br />revert back to the original amount. Motion was seconded by Commissioner <br />Hufford. Motion carried unanimously by voice vote 5 -0. <br />13. CITIZENS' COMMENTS <br />Mayor Glancy announced persons that wished to make comment or make inquiry on any matter not on the <br />agenda, may request to be recognized during Citizens' Comments. Mayor Glancy announced the rules of <br />decorum. The following individuals came forward: <br />Ms. Donna White of Orlando, Chaplain and Honorary Deputy Assistant Chief with the <br />International Association of Volunteer Firefighters, thanked the Casselberly Fine Department <br />and Vice Mayor Solomon for attending a recent ceremony honoring her philanthropic efforts <br />over her years of service. She expressed special gratitude to Vice Mayor Solomon for <br />administering her oath of office. <br />
