CASSELBERRY CITY COMMISSION <br />Minutes of February 9, 2015 — Regular Meeting <br />Page 13 of 14 <br />FACILITY;" AMENDING PART III, ARTICLE V, "ZONING DISTRICT REGULATIONS," TO <br />INCLUDE "ASSISTED LIVING FACILITIES" IN TABLE 2 -5.3 "LAND USE BY DISTRICT" AND <br />AMENDING THE TITLE FOR "NURSING HOMES (REST HOMES AND CONVALESCENT <br />HOMES);" AMENDING PART III, ARTICLE V, "ZONING DISTRICT REGULATIONS," TABLE <br />2 -5.4, "SIZE AND DIMENSION REGULATIONS," TO INCLUDE A FOOTNOTE PROVIDING A <br />REFERENCE TO SECTION 2 -7.33 FOR ASSISTED LIVING FACILITY CRITERIA; AMENDING <br />PART III, ARTICLE VII, "GENERAL REGULATIONS," TO CREATE SECTION 2 -7.33 TO <br />PROVIDE CRITERIA FOR ASSISTED LIVING FACILITIES SUCH AS MINIMUM LIVING <br />SPACE, DENSITY CALCULATION, PARKING REQUIREMENTS, AND OTHER DESIGN <br />REQUIREMENTS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing for Ordinance 15 -1420 was published in the <br />Orlando Sentinel on Thursday, January 29, 2015 for first reading on February 9, 2015. <br />Staff Presentation: Planner Jason Sorensen gave an overview of Ordinance 15 -1420, explaining that the <br />ordinance was for the purpose of updating the City's Code to include uses, requirements and definitions <br />specific to assisted_ living facilities, as the current City Code did not address those. He detailed several of the <br />requested changes, including definitions and criteria such as minimum living space, minimum common area, <br />parking requirements and density calculations. Mr. Sorensen advised that the Public Hearing Notice for <br />Ordinance 15 -1420 was advertised in the Orlando Sentinel, and if approved on first reading, the second <br />reading for Ordinance 15 -1420 would be considered by the Commission at its March 9, 2015 regular meeting. <br />Discussion: A brief discussion ensued during which Mr. Sorensen addressed questions from the Commission <br />regarding consistency with requirements in other cities; parking requirements; criteria for defining "common <br />areas"; and square footage requirements. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Ordinance 15 -1420 on first reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 15 -1420. No one came <br />forward. Mayor Glancy closed the public hearing relative to Ordinance 15 -1420. <br />MOTION: Commissioner Hufford moved to approve Ordinance 15 -1420 on first reading, <br />as presented. Motion was seconded by Vice Mayor Solomon. Motion carried <br />unanimously by voice vote 5 -0. <br />Ms. Reischmann confirmed for the Commission that the mediation in the Pleasants litigation would be held at <br />9:30 on April 10, 2015 and was predicted to take approximately four hours. <br />
