Second Reading of Ordinance 15 -1426 — Moratorium on Approvals for Low -THC <br />Cannabis Dispensing Organization Facilities within the City Limits ofCasselberry. <br />The City Clerk read Ordinance 15 -1426 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, ESTABLISHING A TEMPORARY <br />MORATORIUM OF ONE HUNDRED AND EIGHTY DAYS PROHIBITING THE OPERATION OF ANY <br />LOW -TUC CANNABIS DISPENSING ORGANIZATION FACILITIES WITHIN THE CITY OF <br />CASSELBERRY, AND ON THE ISSUANCE OF BUSINESS TAX RECEIPTS, DEVELOPMENT ORDERS <br />OR PERMITS FOR DISPENSING ORGANIZATION FACILITIES WITH THE CITY LIMITS IN ORDER <br />TO PROVIDE THE CITY AN OPPORTUNITY TO REVIEW AND ENACTREGULATIONS GOVERNING <br />SAID ACTIVITIES; ESTABLISHING A PURPOSE AND INTENT; MAKING CERTAIN FINDINGS; <br />PROVIDING FOR AN ADMINISTRATIVE REMEDY FOR ASSERTIONS OF VESTED RIGHTS AND <br />PROCESSES AND PROCEDRUES RELATING TO SUCH ASSERTIONS; PROVIDING DEFINITIONS; <br />PROVIDING FOR SEVERABILITY; PROVIDING FOR NON - CODIFICATION AND PROVIDING FOR <br />EFFECTIVE DATE" <br />Notice of Public Hearing: The Notice of Public Hearing for Ordinance 15 -1426 was published in the Orlando <br />Sentinel on Thursday, April 30, 2015 and Thursday, May 28, 2015. <br />Staff Presentation: Development Services Manager Randy Woodruff stated that Ordinance 15 -1426 was being <br />presented for second reading and adoption and represented a temporary 180 —day moratorium on issuance of <br />business tax receipts, permits and development orders or any other official action related to low -THC cannabis <br />dispensing organization facilities within the City. He stated he was available for any questions from the <br />Commission. <br />Discussion: A brief discussion ensued regarding the reasoning behind the request for the moratorium. Mr. <br />Woodruff, City Attorney Reischmann and City Manager Randy Newlon clarified that the moratorium was simply <br />for the purpose of allowing staff time to review the State's regulations for the facilities and to develop City <br />regulations which would not be in conflict with those. <br />Budget Impact: There is no impact to the City's budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption of <br />Ordinance 15 -1426. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 15 -1426. The following <br />individuals came forward: <br />Mr. Robert Hall, 654 Longmeadow Circle, Longwood spoke in opposition to the moratorium, <br />citing as his reason the possibility of a more effective treatment for his daughter Meagan, who <br />suffers from a seizure disorder, and others like her who would benefit from these facilities. <br />
