CASSELBERRY CITY COMMISSION <br />Minutes of August 24, 2015 — Regular Meeting <br />Page 10 of 20 <br />The City Clerk read Resolution 15 -2768 by title as follows: <br />G°A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />CLOSING, VACATING AND ABANDONMENT OF A PORTION OF TRIPLET LAKE DRIVE <br />RIGHT- OF-WAY AS PLATTED IN QUAIL POND ADDITION TO CASSELBERRY, FLORIDA, AS <br />RECORDED IN PLAT BOOK 7, PAGE 45, OF THE PUBLIC RECORDS OF SEMINOLE COUNTY, <br />FLORIDA, AND A PORTION OF MUNICIPAL WAY RIGHT- OF-WAY AS PLATTED IN <br />CASSELBERRY MUNICIPAL CENTER, AS RECORDED IN PLAT BOOK 15, PAGE 28, OF THE <br />PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA; AND RETAIN A TEMPORARY <br />PUBLIC ACCESS EASEMENT; PROVIDING FOR SEVERABILITY, CONFLICTS, AND AN <br />EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing for Resolution 15 -2768 was published in the <br />Orlando Sentinel on Thursday, August 13, 2015. <br />Staff Presentation: Permitting & Construction Manager Marty Pawlikowski gave a brief overview of <br />Resolution 15 -2768, explaining that if approved the ordinance would vacate a portion of Triplet Lake Drive <br />starting at U.S. Highway 17 -92 and terminating at approximately the existing traffic circle. He added that this <br />was in anticipation of City Commission approval of the City Center project which required a realignment of <br />Triplet Lake Drive to accommodate the development on the adjacent property. He further explained that the <br />proposed temporary easement would be put in place because of the construction sequencing, noting that ifthe <br />right -of -way were vacated first there would not be a right -of -way for people to ingress and egress until the <br />future road was constructed. He added that the ordinance also contained a clause that in the event the City <br />Center project was not approved, the vacation of the right -of -way and the temporary easement would not be <br />endorsed, as the effective date of the ordinance would be the same as approval of the plat for Lake Concord <br />Park, and the site plan should also be approved at the same time, tying all three together for the approval ofthe <br />City Center. In response to questions from Mr. Newlon, Mr. Pawlikowski reiterated and confirmed that in the <br />event the City did not move forward with the City Center project, the vacation and temporary easement would <br />not take effect. <br />Budget Impact: There is no impact to the City budget. <br />Recommendation: The City Manager and the Public Works Director recommended approval of Resolution <br />15 -2768. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Resolution 15 -2768. The following <br />individual came forward: <br />1. Mr. John Casselberry, 700 South Lost Lake Lane, spoke in opposition to Resolution 15 -2768, <br />stating he felt it was too early to vacate any portion of Triplet Lake Drive or Municipal Way, <br />and he felt it would represent increased liability to the City should any accidents occur within <br />a temporary easement. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Resolution 15 -2768. <br />
