Resolution 15 -2791— Fee Simple Acquisition of the Haas Properties Located off Seminola Boulevard in the Area Platted as Bay Tree Shores "A RESOLUTION OF THE CITY OF CASSELBERRY FLORIDA, DETERMINING THE NECESSITY AND PUBLIC PURPOSE FOR THE FEE SIMPLE ACQUISITION OF A DITCH AND FORMER DRIVEWAY PROPERTY IN THE CITY OF CASSELBERRY, LOCATED OFF SEMINOLA BOULEVARD IN THE AREA PLATTED AS BAY TREE SHORES, BY EMINENT DOMAIN OR THROUGH NEGOTIATION, AND AUTHORIZING THE CITY ATTORNEY TO INITIATE EMINENT DOMAIN PROCEEDINGS TO ACQUIRE THE NECESSARY PROPERTY; PROVIDING FOR SEVERABILITY AND AN IMMEDIATE EFFECTIVE DATE." Introduction: Resolution 15 -2791 establishes public purpose and necessity for the fee simple acquisition by eminent domain or negotiation two parcels owned by Marie Haas which are located off Seminola Boulevard in the area platted as Bay Tree Shores, and authorizes City officers, agents, employees, contractors and attorneys to initiate the acquisition. Budget Impact: There is no impact to the City budget. Recommendation: The City Manager and the Community Development Director recommended approval of Resolution 15 -2791. C. Resolution 15 -2792 — Park Drive Property Donation, Parcel ID #09- 21- 30 -5BP- OB00 -0120 & Related Budget Amendment #16 -002 "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, ACCEPTING A LAND DONATION BY ELIAS MANGUAL AND RAFAEL CLAUDIO AND AUTHORIZING EXECUTION OF A LAND DONATION AGREEMENT FOR PARCEL ID #09-21 - 30- 5BP -OBBO -0120; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." Introduction: Resolution 15 -2792 approves the Land Donation Agreement between Elias Mangual and Rafael Claudio and the City of Casselberly for donation of a vacant parcel located on Park Drive (Parcel ID #09- 21- 30- 5BP -OB00- 0120), and authorizes the Mayor to execute said documents on behalf of the City. Consideration of related Budget Amendment #16 -002 is also requested. Budget Impact: Budget Amendment #16 -002 provides a budget for up to $12,000 from Stormwater operating supplies account #110- 0740 -539 -52.00 to the Stormwater land acquisition account #110 -0740- 539.61-07 to accumulate costs associated with securing title including the payment of past property taxes. BA #16 -002 Explanation of Request: This item seeks City Commission approval to provide funding for outstanding property taxes, estimated legal fees and a survey on a vacant parcel of land that is being donated to the City of Casselberry in exchange for the release of a Code Enforcement lien. This property is located on Park Drive; parcel ID #09- 21- 30- 5BP -OB00 -0120. The property is adjacent to a City -owned Stormwater pond and is of value to the City.
