WHEREAS, the definition of an Active Park includes public use of the master association facilities and the use <br />of the park areas within the Planned Development shall only be for the exclusive use of the property owners within the <br />master association; and <br />WHEREAS, educational facilities and institutions are allowed as a conditional use within ULDR Section 2 -7.26 <br />(C) (3); however, development and design criteria for schools are not provided within ULDR Section 2 -6.26; and <br />WHEREAS, apartments are a permitted use with accompanied development and design criteria; however, the <br />use and associated development and design criteria for condominiums are absent within Section 2 -6.26; and <br />WHEREAS, the Casselberry Planning and Zoning Commission / Local Planning Agency, reviewed this <br />ordinance and found it to be consistent with the City's Comprehensive Plan; and <br />WHEREAS, the City Commission of the City of Casselberry held a duly noticed public hearing on the <br />proposed changes set forth herein and considered advice of staff, citizens, and all interested parties, and after <br />complete deliberation, hereby finds the requested changes serve a legitimate governmental interest in preserving the <br />quality of urban life by encouraging the redevelopment of infill properties and is consistent with the City of Casselberry's <br />Comprehensive Plan; and <br />WHEREAS, words with double underlined type shall constitute additions to the original text and strike through <br />shall constitute deletions to the original text. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS: <br />SECTION I. The foregoing whereas clauses are incorporated herein as legislative findings by this reference <br />and made part hereof for all intents and purposes. <br />SECTION II. The Casselberry Unified Land Development Regulations, Part III, Chapter ll, Article VII, Section <br />2 -7.26, "Seminola Boulevard Overlay District (SB -2) Design Guidelines ", shall be amended as follows: <br />B. Definitions. <br />Apartments /Condominiums.
