enforcement board. To that end, a special magistrate shall have the same status as <br />a code enforcement board under this division. References in this division to an <br />enforcement board shall include a special magistrate. if the context permits, except <br />for Section 2 -148, Board Membership. <br />SECTION 4. Section 2 -148, Chapter 2, Administration, Article IV, Boards, Committees and <br />Commissions, Division 2, Code Enforcement Board, of the Code of Ordinances of the City of <br />Casselberry is hereby amended to read as follows: <br />Sec. 2 -148. Board Membership; appointment and removal of members; term of <br />office; counsel. <br />SECTION 5. The Code of Ordinances of the City of Casselberry, Florida, is hereby <br />amended by adding a new section to be numbered Section 2 -149, Part II, District and General <br />Regulations, Chapter 2, Administration, Article IV, Boards, Committees and Commissions, Division <br />2, Code Enforcement Board, which shall read as follows: <br />Sec. 2 -149. <br />a) Selection. If the city commission chooses to appoint a special <br />magistrate, a committee composed of the city manager, the building official, city <br />attorney and the community development director, shall solicit applications from <br />persons willing to serve as special magistrate, shall interview and evaluate <br />a plicants, and shall make recommendations to the city commission regarding the <br />designation of a special magistrate under this subpart. <br />b) Qualifications. Special magistrates shall be members of the Florida Bar <br />in good standing for five or more years. The Special Magistrate must demonstrate <br />satisfactory knowledge of municipal law and the general procedures for enforcement <br />of municipal codes, and must demonstrate a temperament suitable for the exercise <br />of the quasi- judicial powers vested in each special magistrate <br />c) Compensation. A special magistrate so designated shall be <br />compensated as agreed upon by the special magistrate and the city manager. <br />(d) Duties and powers. Special magistrates shall have the same duties. <br />powers, and limitation on powers as those conferred on the board under this article <br />as the context permits. <br />e) Policies. <br />1) Should the City Commission appoint a special magistrate, the city <br />attorney may attend the code enforcement hearings conducted by the <br />special magistrate and represent the city staff in the presentation of <br />
