B) Site (1) The setback shall be a minimum of 40 feet from the top edge of retention pond bank after the slope of the retention pond bank changes from 4 -to -1 to 5 -to -1. A supporting wall may be used on the interior side of the berm for the encroachment of parking spaces with a maximum of eight (8) feet encroachment allowed. Up to six (6) feet of landscape berm may be provided off -site in the Seminole County right -of -way with their approval. Other design considerations or reductions to the above stated criteria may be approved by the City Commission and City Engineer.
