Notwithstanding the <br />previous sentence: <br />1M if a member is terminated by the city for medical reasons, the terminated <br />person may apply for a disability benefit if the application is filed with the <br />board within thirty (30) days from the date of termination. If a timely <br />application is received, it shall be processed and the terminated person <br />shall be eligible to receive a disability benefit if the board otherwise <br />determines that he is totally and permanently disabled as provided for <br />above. <br />2 If a member has resigned from employment or separated from <br />employment in connection with the resolution of a worker's compensation <br />claim with the city and has, prior to such resignation or separation, applied <br />for a disability pension, then such person's application shall continue to be <br />processed and he shall be eligible to receive a disability benefit if the <br />board otherwise determines that he is totally and permanently disabled as <br />provided for above. <br />SECTION II: Codification: It is the intention of the City Commission of the City of <br />Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become <br />and be made a part of the Code of Ordinances of the City of Casselberry, Florida; that the <br />Sections of this Ordinance may be renumbered or re- lettered to accomplish such intention, that <br />the word "Ordinance," may be changed to "Section," "Article," or other appropriate word. <br />Ordinance 14 -1410 <br />Page 3 <br />
