ORDINANCE 14 -1410 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, <br />FLORIDA, AMENDING CHAPTER 62, PENSIONS AND <br />RETIREMENT, ARTICLE 1, POLICE OFFICERS' AND <br />FIREFIGHTERS' PENSION PLAN, OF THE CODE OF <br />ORDINANCES OF THE CITY OF CASSELBERRY; <br />AMENDING SECTION 62 -2008, DISABILITY TO CLARIFY <br />ELIGIBILITY; PROVIDING FOR CODIFICATION; <br />PROVIDING FOR SEVERABILITY OF PROVISIONS; <br />REPEALING ALL ORDINANCES IN CONFLICT <br />HEREWITH AND PROVIDING FOR A RETROACTIVE <br />EFFECTIVE DATE. <br />WHEREAS, this Ordinance will be applied retroactively in order to address disability <br />claims that have arisen prior to the adoption date of this Ordinance; and <br />WHEREAS, words with double underlined text shall constitute additions to the original <br />text, and words with stricken text shall constitute deletions to the original text contained in <br />Sections 62 -2008 of the Code of Ordinances of the City of Casselberry. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I: That Chapter 62, Pensions and Retirement, Article 1, Police Officers' and <br />Firefighters' Pension Plan, of the Code of Ordinances of the City of Casselberry, is hereby <br />amended by amending Section 62 -2008, Disability, subsection (a), Disabilio) benefits in -line of <br />duty, and subsection (c), Disability benefits not -in -line of duty, to read as follows: <br />(a) Disability benefits in -line of ditol. Any Member who shall become totally and <br />permanently disabled to the extent that he is unable, by reason of a medically <br />determinable physical or mental impairment, to render useful and efficient service <br />as a Police Officer or Firefighter, which disability was directly caused by the <br />performance of his duty as a Police Officer or Firefighter, shall, upon establishing <br />the same to the satisfaction of the Board, be entitled to a monthly pension equal to <br />three percent of his Average Final Compensation multiplied by the total years of <br />Ordinance 14 -1410 <br />Page 1 <br />
