ORDINANCE 14 -1410 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 62, PENSIONS AND RETIREMENT, ARTICLE 1, POLICE OFFICERS' AND FIREFIGHTERS' PENSION PLAN, OF THE CODE OF ORDINANCES OF THE CITY OF CASSELBERRY; AMENDING SECTION 62 -2008, DISABILITY TO CLARIFY ELIGIBILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY OF PROVISIONS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR A RETROACTIVE EFFECTIVE DATE. WHEREAS, this Ordinance will be applied retroactively in order to address disability claims that have arisen prior to the adoption date of this Ordinance; and WHEREAS, words with double underlined text shall constitute additions to the original text, and words with stricken text shall constitute deletions to the original text contained in Sections 62 -2008 of the Code of Ordinances of the City of Casselberry. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I: That Chapter 62, Pensions and Retirement, Article 1, Police Officers' and Firefighters' Pension Plan, of the Code of Ordinances of the City of Casselberry, is hereby amended by amending Section 62 -2008, Disability, subsection (a), Disabilio) benefits in -line of duty, and subsection (c), Disability benefits not -in -line of duty, to read as follows: (a) Disability benefits in -line of ditol. Any Member who shall become totally and permanently disabled to the extent that he is unable, by reason of a medically determinable physical or mental impairment, to render useful and efficient service as a Police Officer or Firefighter, which disability was directly caused by the performance of his duty as a Police Officer or Firefighter, shall, upon establishing the same to the satisfaction of the Board, be entitled to a monthly pension equal to three percent of his Average Final Compensation multiplied by the total years of Ordinance 14 -1410 Page 1
