ORDINANCE NO. 14 -1413 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY OF CASSELBERRY'S <br />COMPREHENSIVE PLAN, BY ADDING TEXT TO POLICY FLU <br />1.17 "RESERVED" TO ESTABLISH "LAKE CONCORD <br />OVERLAY DISTRICT "; AMENDING THE FUTURE LAND USE <br />MAP TO ADD THE FUTURE LAND USE DESIGNATION OF <br />"LAKE CONCORD OVERLAY DISTRICT" TO INCLUDE THE <br />PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE IN <br />ACCORDANCE WITH MANDATES SET FORTH IN CHAPTER <br />163, FLORIDA STATUTES; PROVIDING FOR TRANSMITTAL <br />OF THE PLAN AMENDMENTS TO THE DEPARTMENT OF <br />ECONOMIC OPPORTUNITY; AND PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry seeks to develop currently underutilized <br />land within the City for the economic and social benefit of the City and its residents; and <br />WHEREAS, the City wishes to create an overlay district known as "Lake <br />Concord Overlay District" to encourage development of underutilized land for the <br />properties described in Section I; and <br />WHEREAS, the City adopted a set of guiding principles for development for this <br />area at their City Commission meeting on May 14, 2012; and <br />WHEREAS, the City of Casselberry has contracted with developers to pursue the <br />City's vision within the overlay district; and <br />WHEREAS, the text being added to Policy FLU 1.17 and the properties provided <br />in Section I of this ordinance are greater than 10 acres requiring a large scale amendment <br />to the Comprehensive Plan; and <br />WHEREAS, Section 163.3184, Florida Statutes establishes a process for <br />adoption of a large scale amendment to the Comprehensive Plan which requires review <br />by the State Land Planning Agency/Department of Economic Opportunity (DEO) and <br />relevant review agencies and public hearings; and <br />WHEREAS, Unified Land Development Regulations Section 1 -2.6 requires the <br />Planning and Zoning Commission acting as the Local Planning Agency to coordinate and <br />make recommendations for changes to the Comprehensive Plan and Future Land Use <br />Map as may be required from time to time; and <br />WHEREAS, the Future Land Use Map (FLUM) of the City's Comprehensive <br />Plan currently designates the subject properties in Section I of this ordinance as Major <br />Ordinance 14 -1413 <br />Page 1 of 4 <br />
