WHEREAS, the City Commission of the City of Casselbeny finds that it is appropriate and furthers the public good to provide authorization for Seminole County to assess and collect through uniform method the aquatic weed control cost share allocation from Lake Howell waterfront parcels and parcels with a right to use a waterfront parcel within the City limits. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. Sections 78 -1 and 78 -2 of Article I of Chapter 78, Taxation, are hereby created as follows: See. 78 -1. - APPROVAL OF INCLUSION OF CERTAIN PROPERTIES LOCATED IN THE CITY OF CASSELBERRY IN THE MSBU. The City Commission of the City of Casselbeny, Florida, hereby approves and authorizes the inclusion of Lalce Howell waterfront parcels and properties with a right to use waterfront parcels within the City limits into the County's Lake Howell Municipal Service Benefit Unit boundaries, said properties more fully described as set forth in Exhibit "A ", [Exhibit "A" not codified] attached hereto and incorporated herein by reference. See. 78 -2. - TERM. This Ordinance shall remain in full effect for the duration of the Lake Howell MSBU or until such time as the Casselbeny City Commission repeals Sec. 78 -1 following procedures set out in Florida Statutes, Section 166.041, whichever first occurs. Notice of the proposed repeal of Sec. 78 -1 shall be provided in writing to Seminole County no later than March 1 of the year in which the City intends to terminate the County's aquatic weed control services to avoid imposition of non -ad valorem assessments for that tax year. SECTION 2. CODIFICATION. It is the intention of the City Commission of the City of Casselbeny, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Casselbeny, Florida; that the Sections of this Ordinance may be renumbered or re- lettered to accomplish such intention; that the word, "Ordinance" may be changed to "Section," "Article," or other appropriate word; providing however, that Exhibit "A" shall not be codified. SECTION 3. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTION 4. SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance.
