ORDINANCE 15 -1417 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />CREATING SECTIONS 78 -1 AND 78 -2, ARTICLE I, GENERAL, OF <br />CHAPTER 78, TAXATION, AUTHORIZING THE INCLUSION OF <br />CERTAIN PROPERTY LOCATED WITHIN THE CITY OF CASSELBERRY <br />IN THE LAKE HOWELL AQUATIC WEED CONTROL MUNICIPAL <br />SERVICE BENEFIT UNIT CREATED AND ESTABLISHED BY SEMINOLE <br />COUNTY, FLORIDA, FOR THE PURPOSE OF PROVIDING AQUATIC <br />WEED CONTROL TO THE LAKE AND CONNECTIVE WATERWAY <br />AREAS WITHIN THE UNIT; PROVIDING IDENTIFICATION OF <br />PROPERTY WITHIN THE CITY OF CASSELBERRY AUTHORIZED FOR <br />INCLUSION IN SAID UNIT; PROVIDING FOR PERIOD OF <br />EFFECTIVENESS; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Commission of the City of Casselbeny, Florida, has entered into the <br />Lake Howell Interlocal Agreement with Seminole County, Florida, whereby the City has agreed to <br />authorize inclusion of certain lands lying in the City of Casselbeny in a Municipal Service Benefit Unit <br />( "MSBU ") to be created and established by Seminole County to provide for the control of aquatic <br />vegetation in Lake Howell; and <br />WHEREAS, the Board of County Commissioners of Seminole County, Florida, has the <br />authority to establish a Municipal Service Benefit Unit pursuant to Chapter 125, Florida Statutes, and <br />other controlling law; and <br />WHEREAS, there are Lake Howell waterfront properties and properties with a right to use <br />waterfront properties located within the City of Casselbeny and unincorporated Seminole County that <br />will benefit from aquatic weed control improvements to the lake; and <br />WHEREAS, pursuant to Chapter 163, Florida Statutes, local governments are encouraged to <br />cooperate on the basis of mutual advantage to provide services that will influence the needs of local <br />communities; and <br />WHEREAS, the City Commission of the City of Casselbeny enacts this Ordinance to ensure <br />that the high quality of life available to citizens of the City and the County is protected and maintained; <br />and <br />WHEREAS, Article VII, Section 2, Constitution of the State of Florida, authorizes the City of <br />Casselbeny to exercise any power for municipal purposes except as otherwise provided by law and <br />Chapter 166, Florida Statutes, vests broad home rule authority in the City; and <br />Ordinance 15 -1417 <br />Page 1 <br />
