4. The City Manager may appoint: <br />a. A representative of the Florida Department of Agriculture and Consumer <br />Services, Division of Forestry, a landscape architect, arborist or other similar <br />landscape professional; and /or, <br />b. A resident and/or business person within the City of Casselberry. <br />C. Officers and procedures. The chairperson and vice chairperson of the City Tree <br />Advisory Committee shall be alternated on an annual basis from January 1 st of each <br />year. A record of findings, decisions and recommendations shall be kept by the <br />committee in a location accessible to all members. Meetings of the City Tree <br />Advisory Committee shall be open to the public and shall be held at the call of the <br />chairperson and /or at such times as the City Tree Advisory Committee shall <br />determine. <br />D. Powers and duties. <br />1. The City Tree Advisory Committee shall have the authority to develop and <br />administer a comprehensive program for the care, preservation, and management <br />of trees in parks, along streets, in stormwater management facilities, and in all <br />other public areas. <br />2. The City Tree Advisory Committee shall, when requested by the City <br />Commission, City Manager, or any Department Head, consider, investigate, <br />report and snake recommendations on any special matter or question coming <br />within the scope of its duties. <br />3. The City Tree Advisory Committee shall review designations for specimen trees <br />and make recommendations to the Development Review Committee, Planning <br />and Zoning Commission or City Commission regarding such. <br />4. The City Tree Advisory Committee's recommendations shall be by consensus of <br />the members. The Committee shall transmit its recommendations to the <br />appropriate reviewing authority including but not limited to the City Commission <br />and the Planning and Zoning Commission. The powers and duties of the City Tree <br />Advisory Committee shall include other responsibilities and authority as <br />specifically set forth in this ordinance. <br />5. The City Tree Advisory Committee may make recommendations to the City <br />Commission designating expenditures from the City Tree Bank for projects within <br />the community. <br />Section 3 -14.5. Tree Protection and Survival. <br />A. Burden of tree protection is on the property owner. It shall be the responsibility of the <br />property owner, developer or applicant to ensure that any tree shown on the tree <br />inventory for which a tree removal permit has not been obtained, be protected. The <br />property owner shall guarantee survival of retained or replacement trees. <br />B. Restrictions during construction. It shall be unlawful for any person, during the <br />construction of any structures or other improvements, to place any material (such as <br />oil, solvent, concrete) which may be harmful to the tree, machinery, or temporary soil <br />deposits within the dripline of any tree for which a tree removal permit is required but <br />has not been obtained. This provision includes soil that is placed in the dripline <br />permanently for the purpose of a grade change, unless the grade is changed according <br />to the guidelines described in the Florida Division of Forestry, Department of <br />Ordinance 15 -1419 <br />Page 6 <br />
