The private sewage treatment and disposal system or <br />septic tank shall be cleaned and abandoned as directed by the controlling regulatory agencies or the <br />City. This Subsection is subject to the specific provisions of Subsection 86- 68(d). <br />(fl Payment plan for, connection of customers to city's sen;era system. <br />(1) The following options for payment of all connection fees incident to connection to the <br />City sewer system shall be offered to owners of property at such time as said properties are required <br />to connect to the City's sewer system: <br />Option 1: Full payment within 90 days of actual connection to the system. <br />Option 2: Payment in 24 equal monthly installments with the first installment due 90 <br />days after actual connection to the system. <br />Option 3: If the connection fees exceed $5,000, payment in 60 equal monthly <br />installments with the first installment due 90 days after actual connection to the <br />ss s <br />(2) A property owner electing to finance the connection fee or a portion thereof will repay <br />the fee through a monthly bill and will be subject to collection actions authorized by Code or Florida <br />Statutes. If any payment under Options 2 or 3 is not made within 30 days after the date same is due <br />and payable, the entire balance shall become due and payable without notice. In addition, the City <br />reserves the right to exercise such other authority as it has to enforce payment, including but not <br />limited to, the discontinuance of water service until the full balance then due and owing is paid. <br />3) Security for navment: <br />a. In the event that an affected property owner shall elect to nay the required <br />connection fee as provided for by in Options 2 and 3 hereof, the owner shall provide the City <br />with evidence of actual title to the affected property and all persons having an ownership <br />interest shall be required to join in the application for service. Owners who elect to finance <br />the connection fee pursuant to this subsection must execute a promissory note secured by a <br />lien on the property prior to connecting to the system or within ninety (90) days from the <br />completion date, whichever comes first. Said lien must_ be paid in full prior to transfer or <br />sale of the property. <br />b. The Finance Director is hereby authorized and directed to prepare such forms and <br />agreements as are necessary to carry out the intent of this section. <br />Enforcement. In the event an owner fails or refuses to timely connect to the City's sewer <br />system, the City may employ any legally available remedy, including but not limited to, injunctive <br />relief, and use of the code enforcement process. In the event the City is required to resort to legal <br />action, all costs incurred, including attorney's fees and court costs, shall be assessed to the owner. <br />The City Manager is authorized to initiate such proceedings as are permitted by law to enforce any <br />
