ORDINANCE 15 -1433 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, <br />FLORIDA, AMENDING SECTION 86 -31, PRIVATE <br />SEWAGE DISPOSAL SYSTEMS, TO ALLOW <br />PROPERTY OWNERS THE OPTION TO PAY OVER <br />FIVE YEARS FOR CONNECTION TO THE CITY <br />SEWER SYSTEM IN CERTAIN CIRCUMSTANCES; <br />PROVIDING FOR A LIEN AND FOR ENFORCEMENT; <br />PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS, Section 86 -31 currently provides an owner of a properly functioning septic tank <br />the option to prepay the fees to connect to City sewer over two years time; and <br />WHEREAS, through this Ordinance, the City Commission hereby delegates to the City <br />Manager the authority to offer a payment plan in limited circumstances, where the connection costs <br />exceed $5,000 and where a lien is placed on the property to incentivize prompt connection to City <br />sewer for the protection of the public health and safety; and <br />WHEREAS, the City Commission desires to include a means for enforcement of the <br />connection requirement; and <br />WHEREAS, words with double underlined type shall constitute additions to the original text <br />and stfi e t <.eulgi, shall constitute deletions to the original text, and asterisks (* * *) indicate that text <br />shall remain unchanged from the language existing prior to adoption of this Ordinance. <br />NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of <br />Casselberry, Florida: <br />SECTION 1. Section 86 -31, Private sewage disposal systems, is hereby amended as <br />follows: <br />See. 86 -31. - Private sewage disposal systems. <br />* ** <br />(c) Connection to public system. <br />(1) The owner of a properly functioning private sewage treatment and disposal system must <br />connect the system or the building's plumbing to an available public sanitary sewer within 365 days <br />after written notification by the City that the system is available for connection. The City will notify <br />the owner of the private sewage treatment and disposal system of the availability of the public <br />sanitary sewer. No less than one year prior to the date the public sanitary sewer will become <br />available, the City will notify the affected owner of the private sewage treatment and disposal system <br />of the anticipated availability of the public sanitary sewer and shall also notify the owner that the <br />owner will be required to connect to the public sanitary sewer within one year of the actual <br />
