SECTION I. GENERAL PROVISIONS <br />1.0 AUTHORITY AND PURPOSE <br />Florida Statutes Chapter 166 and the Charter of the City of Casselberty grant authority to the City <br />Commission for the City of Casselberty, Florida to enact the provisions of this Policy. The City <br />Commission recognizes that fair and open competition is a basic tenet of public procurement; that <br />such competition reduces the appearance and opportunity for favoritism and inspires public <br />confidence that contracts are awarded equitably and economically; and that documentation of the <br />acts taken and effective monitoring mechanisms are important means of curbing any improprieties <br />and establishing public confidence in the process by which Commodities and contractual services <br />are processed. The purchase of all Commodities and services will be in accordance with City <br />policy, codes, regulations and all applicable Federal laws and State Statutes. <br />The purpose of the City of Casselberty Purchasing Policy is to: <br />A. Simplify, clarify and modernize the policies governing Procurement by the City; <br />B. Permit the continued development of Procurement policies and procedures; <br />C. Provide for increased public confidence in the procedures followed in public <br />Procurement; <br />D. Ensure the fair and equitable treatment of all Persons who do business with the City; <br />E. Provide increased economy in City Procurement activities and maximize, to the <br />fullest extent practicable, the purchasing value of public monies of the City; <br />F. Promote effective broad -based competition within the free enterprise system; <br />G. Provide safeguards for the maintenance of a Procurement system of quality and <br />integrity; and <br />H. Obtain in a cost - effective and timely manner the quality Goods, Services, and <br />Construction as required by the City to better serve its citizens. <br />1.1 APPLICABILITY AND EXCLUSIONS <br />A. The provisions of this Policy shall apply to the Purchase/Procurement of Goods, <br />Services, and Construction by the City Commission and the <br />Divisions/Departments /Offices under the control of the City Commission. <br />Expenditures of Federal or State assistance funds and Grants will be conducted in <br />accordance with the applicable mandatory Federal and State laws and regulations, <br />which may not be reflected in this Policy or may be inconsistent with any provision <br />of this Policy. However, nothing in this Policy shall prevent the City from <br />complying with the terms and conditions of any Grant, Contract, gift or bequest that <br />is otherwise consistent with law. <br />B. The following are exempt from the Competitive Solicitation provisions of this <br />Policy, but do not preclude the City from competitive selection: <br />Page 4 <br />
