Mr. Bryan made a motion that the Planning and <br />Zoning Commission provide a favorable recommendation of SPR 15 -14 in regards to the Development of Community <br />Impact application for The Geneva School at Legacy Park and this recommendation is based on the revised site plan <br />dated November 10, 2015, the findings of fact and conclusions of the information provided in the staff report dated <br />November 18, 2015, subject to the 12 conditions outlined in the staff, exhibit A -D and including a favorable <br />recommendation of the staffs recommendations on the waivers. A clarification of the motion was made to state the <br />Commission supports the denial of the 6 foot chain link fence. Ms. Campbell seconded the motion. The motion <br />passed unanimously by voice vote. <br />Ms. Babb- Nutcher excused herself from the meeting at 8:00 p.m. <br />Tenth Item of Business: CU 15 -10: 1275 S US HWY 17.921 Sambumbia Restaurant. Conditional Use for selling <br />beer and wine in a CG (Commercial General) zoning district. <br />Mr. Dean Fathelbab, Planner I, reviewed the information provided in staffs memorandum dated November <br />18, 2015, and a PowerPoint Presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint Presentation is attached and made a part of the minutes). He said staff recommends approval for CU <br />15 -10 based on the findings of fact and conclusions of the staff report dated November 18, 2015, and the conditions <br />of approval listed in the staff report. <br />Mr. Henson asked the applicant to come forward. Mr. Bernardo Mercado, 615 Blenheim Loop, Winter <br />Springs, Florida came forward. There were no questions for the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address CU 15 -10. Ms. Campbell made a motion that the Planning and <br />Zoning Commission approve CU 15 -10 to allow on -site consumption of alcoholic beverages, 2COP, in conjunction <br />with the operation of a restaurant located at 1275 South US Highway 17 -92.
