Planning & Zoning Commission/ <br />Local Planning Agency <br />June 10, 2015 <br />Page 2 <br />3. The sale of alcohol shall not exceed 49% of total revenue. <br />4. The conditional use approval is for alcohol sales in conjunction with a restaurant which primarily serves food. <br />5. Package sales of alcoholic beverages for off -site consumption are prohibited. <br />6. The hours of on -site alcohol consumption and sales shall comply with the hours set forth in Section 10.2 of the <br />City of Casselberry's Code and shall only be during times when the primary use (the restaurant) is serving food. <br />7. The business shall remain in complete compliance with all City, County and State requirements. <br />8. There shall be no outside display or storage of goods, materials, services or vehicles. <br />9. The conditional use shall commence within 120 days of the approval. <br />10. The conditional use shall expire if the use is discontinued for more than 90 days. <br />11. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void <br />A brief discussion ensued regarding the auditing responsibilities for the required percentage of food and alcohol sales <br />for the alcohol license. Mr. Henson asked if the Commission had any Ex Parte Communications for this item. No disclosure of <br />Ex Parte Communications was made by the Commissioners. <br />Mr. Henson asked the applicant to come forward. Mr. Anthony Edwards, 142 Varsity Circle, Altamonte Springs, Florida <br />came forward. There were no questions for the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. <br />No one came forward. <br />Mr. Henson asked for a motion to address CU 15 -04. Mr. Bryan made a motion that the Planning and Zoning <br />Commission approve CU 15 -04, conditional use to allow the on -site consumption of alcoholic beverages as allowed by the <br />2COP state license, for the property located at 1401 State Road 436. He said the approval is based on the findings of fact and <br />conclusions of the staff report dated June 10, 2015, and the eleven (11) conditions included in the staff report. Mr. Bakalla <br />seconded the motion. The motion passed unanimously by voice vote. <br />Fifth Item of Business: CU 15 -05: 317 Semi nola Boulevard. Conditional use request for a residential dock. <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated June 10, 2015, and a <br />PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the PowerPoint presentation is <br />attached and made a part of the minutes). Ms. Regan said staff recommends approval with the five (5) conditions of approval <br />outlined in the staff report. The following is a list of the conditions of approval: <br />1. The conditional use shall be limited to the proposed dock structure. The dock shall not be enlarged or enhanced <br />in any way without additional conditional use approval by the Planning and Zoning Commission. <br />2. The construction and maintenance of the dock shall be in accordance with the requirements of all applicable state <br />agencies, the City Engineer's conditions of approval, and the City's ULDR. <br />3. The applicant shall incorporate dock lighting into the plans prior to submitting for a building permit. This lighting <br />shall illuminate the entire length of the dock as required by Section 94 -6. <br />
