Planning & Zoning Commission/
Local Planning Agency
December 10, 2014
Page 5
Mr. Hale asked for a motion to address BA 14 -04. Mr. Henson made a motion that the Planning and Zoning
Commission grant the variance requested for BA 14 -04, for the property located at 231 South Triplet Lake Drive, to allow a
maximum 3 foot encroachment into the required 10 foot side yard setback, the motion is based upon the Planning and Zoning
Commission's findings of fact and conclusions, the property site plan attached as Exhibit B to the staff report, and the following
conditions:
1. The variance shall only pertain to the proposed garage addition shown in Exhibits D and E attached to the staff
report.
2. The additions shall meet all other site development criteria.
3. The garage addition may not be utilized for any commercial purposes.
4. A building permit for the additions shall be obtained within 1 year of the approval by the Planning and Zoning
Commission.
5. All of the above conditions shall be fully and faithfully executed or the variance shall become null and void.
Findings of fact made by the Planning and Zoning Commission were that no special privileges would be conferred upon the
applicant by approval of this variance and a hardship exists even though there is an alternative to the variance request but it
would be more difficult and costly than the applicant is currently proposing. The alternative may not be aesthetically pleasing
as they continue with the existing housing line.
Mr. Bakalla seconded the motion.
The Board was polled:
Ron Bryan Yes
Nathan Van Meter Yes
David Henson Yes
Edmund Bakalla Yes
Raymond Wise Yes
Daniel Hale Yes
Victor Lutz Yes
The motion passed unanimously.
Ninth Item of Business: CU 14 -20 — 1810 State Road 436 - Veterinary Clinic. Conditional use request to allow
veterinary medical services, without outside kennels, in the CG zoning district.
Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated December 10, 2014,
and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the PowerPoint
presentation is attached and made a part of the minutes). Mr. Sorensen said staff recommends approval of CU 14 -20 based
on the nine conditions of approval outlined in the staff report.
