Planning & Zoning Commission/ <br />Local Planning Agency <br />December 10, 2014 <br />Page 5 <br />Mr. Hale asked for a motion to address BA 14 -04. Mr. Henson made a motion that the Planning and Zoning <br />Commission grant the variance requested for BA 14 -04, for the property located at 231 South Triplet Lake Drive, to allow a <br />maximum 3 foot encroachment into the required 10 foot side yard setback, the motion is based upon the Planning and Zoning <br />Commission's findings of fact and conclusions, the property site plan attached as Exhibit B to the staff report, and the following <br />conditions: <br />1. The variance shall only pertain to the proposed garage addition shown in Exhibits D and E attached to the staff <br />report. <br />2. The additions shall meet all other site development criteria. <br />3. The garage addition may not be utilized for any commercial purposes. <br />4. A building permit for the additions shall be obtained within 1 year of the approval by the Planning and Zoning <br />Commission. <br />5. All of the above conditions shall be fully and faithfully executed or the variance shall become null and void. <br />Findings of fact made by the Planning and Zoning Commission were that no special privileges would be conferred upon the <br />applicant by approval of this variance and a hardship exists even though there is an alternative to the variance request but it <br />would be more difficult and costly than the applicant is currently proposing. The alternative may not be aesthetically pleasing <br />as they continue with the existing housing line. <br />Mr. Bakalla seconded the motion. <br />The Board was polled: <br />Ron Bryan Yes <br />Nathan Van Meter Yes <br />David Henson Yes <br />Edmund Bakalla Yes <br />Raymond Wise Yes <br />Daniel Hale Yes <br />Victor Lutz Yes <br />The motion passed unanimously. <br />Ninth Item of Business: CU 14 -20 — 1810 State Road 436 - Veterinary Clinic. Conditional use request to allow <br />veterinary medical services, without outside kennels, in the CG zoning district. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated December 10, 2014, <br />and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the PowerPoint <br />presentation is attached and made a part of the minutes). Mr. Sorensen said staff recommends approval of CU 14 -20 based <br />on the nine conditions of approval outlined in the staff report. <br />
