Alcohol sales and on -site consumption shall not be permitted beyond 11:00 p.m. <br />6. Package sales of alcoholic beverages for off -site consumption are prohibited. <br />7. The business shall remain in complete compliance with all City, County and State requirements. <br />8. There shall be no outside display or storage of goods, materials, services or vehicles. <br />9. The conditional use shall commence within 120 days of the approval. <br />10. The conditional use shall expire if the use is discontinued for more than 90 days. <br />11. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. <br />Mr. Henson asked the applicant to come forward. Mr. Net Zor, Manager, 1870 State Road 436, Winter Park, Florida <br />came forward. Mr. Zor requested to expand the hours of operation to 3:00 a.m. to hold special events. A brief discussion <br />ensued regarding extending the hours of operation for the sale of alcohol. <br />Mr. Roki Radulovic, landlord, Orlando, Florida came forward. Mr. Radulovic explained that the business owner does <br />not speak English and he felt the manager did not present the information correctly. Mr. Radulovic said that it was always the <br />applicant's intention to cater to parties for their ethnic community. He said the business is currently open 11:00 a.m. to 11:00 <br />p.m. He said the bar has been eliminated from the restaurant. He said a good portion of their business will be for parties and <br />catering and they would like to expand the hours during these events. Mr. Radulovic said that it is a buffet type restaurant and <br />the food is out at all times. <br />A lengthy discussion ensued regarding extending the hours of operation for the sale of alcohol. Mr. Sorensen <br />explained that this item was reviewed using the conditional use criteria for a restaurant use. He said when the hours are <br />extended it becomes more of a bar use and that has additional requirements such as distance separation from churches and <br />schools. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Henson asked for a motion to address CU 14 -19. Mr. Bryan made a motion that the Planning and Zoning <br />Commission approve CU 14 -19, to allow the on -site consumption of beer, wine and liquor in conjunction with the operation of <br />a restaurant located at 1870 State Road 436, based on the findings of fact and conclusions of the staff report dated <br />September 10, 2014, including the eleven conditions of approval with a modification to Condition No. 5 to read: "Alcohol sales <br />and on -site consumption shall not be permitted beyond 12:00 a.m." Mr. Van Meter seconded the motion. The motion passed <br />with a majority vote with Mr. Weinroth casting a dissenting vote. <br />
