Planning & Zoning Commission( <br />Local Planning Agency <br />June 11, 2014 <br />Page 2 <br />3. The sale of alcohol shall not exceed 49% of total revenue. <br />4. Package sales of alcoholic beverages for off -site consumption are prohibited. <br />5. The hours of alcohol sales shall comply with the hours set forth in Section 10.2 of the City of Casselberry's Code <br />as long as the use is in conjunction with a restaurant. <br />6. The business shall remain in complete compliance with all City, County and State requirements. <br />7. There shall be no outside display or storage of goods, materials, services or vehicles. <br />8. The conditional use shall commence within 120 days of the approval. <br />9. The conditional use shall expire if the use is discontinued for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. <br />Mr. Meadows asked the applicant to come forward. The applicant was not present at the meeting. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Meadows asked for a motion to address CU 14 -10. Mr. Bryan made a motion that the Planning and Zoning <br />Commission approve CU 14 -10 to allow the on -site consumption of beer and wine as allowed by the 2COP state license, in <br />conjunction with the operation of a restaurant located at 1555 State Road 436 Suite 1321, based on the findings of fact and <br />conclusions of the staff report dated June 11, 2014, and the ten conditions outlined in the staff report. Mr. Van Meter <br />seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: Commercial Mascots and Human Commercial Message Signs. <br />Mr. Meadows said that staff has requested this item be postponed to a future date. <br />Seventh Item of Business: LPA 14.02 — Landscape and Tree Protection: A workshop to discuss a draft ordinance <br />amending Article XIII Landscape and Article XIV Tree Protection to revise replacement requirements and update <br />standards. <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated June 11, 2014, to the City <br />of Casselberry Planning and Zoning Commission. Ms. Regan presented a PowerPoint presentation (a copy is attached and <br />made a part of the minutes). <br />The Planning and Zoning Commission reviewed Exhibits A and B that were included in the agenda packet. The <br />Commission questioned the training of code enforcement personnel to enforce the landscape regulations and the shrub height <br />required at planting for the buffering requirement. The Commission requested staff make clarifications to the new <br />development wording in Section 3 -13.8 Development landscape requirements and the berm height in Section 3- 13.9B.7b. <br />In response to the Commission's question, Ms. Regan explained that no changes have been made to residential tree <br />removal requirements for properties that are not located in a planned residential development.
