Mr. Tiago Azevedo, 9203 Cypress Cove Drive, <br />Orlando, Florida came forward. In response to the Commission's question, Mr, Azevedo said that the church did not <br />want the court used after daylight. He said the proposed basketball court would replace the court currently on the <br />site. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />After a brief discussion, Mr. Meadows asked for a motion to address SPR 14 -04, Mr. Hale made a motion <br />to approve the major site plan application for a basketball court (SPR 14 -04). He said the recommendation is based <br />on the site plan attached to the staff report, the findings of fact and conclusions of the staff report dated April 9, 2014, <br />and subject to the conditions outlined in the staff report and changing condition number 1 to read: "that in lieu of the 6 <br />foot solid fence the applicant may plant viburnum hedges with a minimum of 24 inches in height and 3 foot on center <br />and the hedges will be allowed to grow to a height of at least 6 feet." Mr. Bryan seconded the motion. The motion <br />passed unanimously by voice vote. <br />Tenth Item of Business: Other Business. <br />Ms. Marie Regan, Planner II, explained that at a previous meeting the Commission had discussed zoning for <br />medical marijuana establishments. Ms. Regan distributed a handout to the Commission regarding information she <br />received from the American Planning Association (a copy is attached and made a part of the minutes), <br />In response to the Commission's question, Ms. Regan said that she is planning on scheduling the tree and <br />landscape information for the May Planning and Zoning Commission meeting. <br />A brief discussion ensued regarding a dialogue that took place at a City Commission meeting regarding the <br />Planning and Zoning Commission not requiring more from an applicant than the regulations required. The <br />Commission requested that a workshop be scheduled with the City Commission, the Planning and Zoning <br />Commission and staff to discuss how to legally address applications that come before the Planning and Zoning <br />Commission. It was stated that requiring more than the Code requires could result in lawsuits and the Code is the <br />
