this is a non - conforming use of the property and continues to be in violation. Mr. Hernandez advised that <br />Jason Sorensen, City Planner was present as a witness. <br />Jason Sorensen, Planner I, City of Casselberry advised that he had several items to submit as exhibits. <br />Each exhibit was entered into record and explained, City's exhibits 1 -9 were entered into record. Mr. <br />Sorensen stated that 54 Seminola is using this site (100 Seminola) to park their cars and they do have <br />advertising, in conjunction with the car sales. A photo taken on 3/20/2014, shows detailing cars before <br />they sell them. <br />Mr. Sorensen stated that with all the evidence shown, they are using this site; it is a non- confonning use. <br />The site was expanded illegally to 100 Seminola and they are required a Business Tax Receipt for the <br />activity, but it would be denied, because auto sales have to be at least 3 acres. <br />The Special Magistrate asked if the properties were present. <br />Can Gulerny, owner of the property, 54 Seminola Blvd, advised that he understands a totally different <br />explanation, totally wrong explanation. Mr. Gulerny stated the City of Casselberry still doesn't know <br />what 54 Seminole Blvd is and what 58 Seminola Blvd is and what is 100 Seminola Blvd. In the picture it <br />is 100 Seminola Blvd, the main property is 54 Seminola Blvd, it is a joint property. There are 2 <br />occupational licenses for 54 and 58 Seminola Blvd. Mr. Gulerny stated that this has been a car dealer <br />since 1980. The property at 54 Seminola Blvd was purchases in 1997. In 2007 Seminole County wrote a <br />letter, offering 100 Seminola Blvd. The property was annexed in 2011, when Casselberry took over from <br />Seminole County. Mr. Gulernry continued. <br />The Special Magistrate asked if there was anyone else to speak for these cases. <br />Mr. Sorensen was unsure of when the property (100 Seminola Blvd) was purchased. <br />Mr. Gulerny stated 100 Seminola Blvd was purchased in August 2007. <br />Mr. Sorensen stated it's unclear when the activity of car sales began at 100 Seminola Blvd., it became <br />apparent when this case was started, which was clearly after the time it was annexed and the code was in <br />effect. The combination of the properties occurred in 2014, just recently. <br />The Special magistrate advised the audience that people just can't be shouting. <br />Mr. Sorensen stated that the violation was started by Todd (Hull) in March of 2014, so the activity for car <br />sales was going on rather recently. <br />The Special Magistrate asked what would be the affect if the activity began shortly after the purchase. <br />Discussion. <br />The Special Magistrate asked when the annexation was. <br />Mr. Sorenson stated he did not know but the applicant may know. It was also to his knowledge while he <br />has been with the City, since 2010. <br />The Special Magistrate asked if you were to take 100 Seminola Blvd in isolation that activity still <br />couldn't go on. <br />3 f Page <br />
