Violations of ULDR Section 2- 8.5.1. on the subject property were first observed on July 29, 2013. On August 14, 2014, it <br />was ordered that this property be brought in compliance on September 28, 2014, or be subject to a $25 per day fine. The <br />subject violation was found to be corrected and the property in compliance of ULDR Section 2- 8.5.1. on November 4, <br />2014, and, therefore, a fine of $960.90 was imposed. <br />The subject repeat violations were found on December 9 and 17, 2014. The subject property was found to be in <br />compliance of ULDR Section 2 -8.5.1 on December 30, 2014, January 6, 2015, and January 8, 2015. Staff recommends a <br />fine of $250 each day that the repeat violation had occurred. <br />Chad Lingenfelter, Development Services Manager advised that we had this violation previously and there were some <br />materials describing the boundaries of the property, which are also boundaries of where auto sales can occur. The plat <br />from 1926 was shown. Mr. Lingenfelter described the boundary and legal description. The City contends there is a <br />repeating violation, it has been observed these vehicular sales are not staying on the property, but wandering onto the next <br />property and other properties further south. <br />Mr. Lingenfelter described the vehicles on the property. <br />Can Gulemy, property owner of 54 Scminola Blvd. <br />The Special Magistrate asked if Mr. Gulerny had a response to what the City is saying about the property being in <br />violation of the code. <br />Mr. Gulemy stated yes, but he does not understand or accept this violation. A letter was received about this violation with <br />pictures, showing what it's about. Mr. Gulerny stated he is the landlord of this property and accepts all the rules for 100 <br />Seminola Blvd_ <br />Mr. Gulerny advised that he wants the occupational license for this property, under his company name. Discussion <br />continued. <br />FINDING OF FACT: The Special Magistrate stated based on the above testimony of record, the property 54 Seminola <br />Blvd was in repeat violation of the City Code 2 -8.5 1. The Original order was dated August 14, 2014, the property had <br />come into compliance and a standing order with regard to repeat violation was entered. It was found that the subject <br />property was in violation for between December 9'h and December 17t', 2014, all dates inclusive (9 days). A fine of $250 <br />per day, for each of the 9 days, totaling $2,250, to be paid within 30 days of the date of the order. <br />The Special Magistrate stated he understood the property owner's issues, but the property owner is ultimately responsible <br />regardless of whom the property is leased to. <br />OTHER BUSINESS <br />There was no other business to discuss. <br />PUBLIC CONLIMENT <br />There were no public comments. <br />ADJOURNMENT OF MEETING <br />The Special Magistrate adjourned the meeting at 7:41pm <br />Date: 17 I y <br />Date:` <br />4 j °age <br />
