ORDINANCE 15 -1425 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; <br />AMENDING THE CITY OF CASSELBERRY CODE OF ORDINANCES, <br />PART III, SECTION 2 -7.26, "SEMINOLA BOULEVARD OVERLAY <br />DISTRICT (SB -2) DESIGN GUIDELINES," DELETING "ASSISTED LIVING <br />FACILITY" AND 'INDEPENDENT LIVING FACILITY" DEFINITIONS; <br />AMENDING SUBPARAGRAPH 2- 7.26.C.4.a, ELIMINATING EXHIBIT <br />B, "LAND USE CONCEPT PLAN," AND REFERRING TO <br />SUBPARAGRAPH 2- 7.26.C.3.a, "PERMITTED, CONDITIONAL AND <br />PROHIBITED USES," FOR LAND USES ALLOWED WITHIN THE SB -2 <br />OVERLAY DISTRICT; AMENDING SUBPARAGRAPH 2- 7.26.C.4.b, <br />"DENSITY AND INTENSITY," TO INCREASE THE DENSITY ALLOWED <br />FOR ASSISTED LIVING FACILITIES; PROVIDING MINIMUMS AND <br />MAXIMUMS FOR SETBACKS AS WELL AS A LANDSCAPE BUFFER TO <br />PROPERTIES OUTSIDE THE SB -2 OVERLAY DISTRICT AND ALONG <br />SEMINOLA BOULEVARD AND SECONDARY STREETS; REDUCING <br />THE MINIMUM LIVING AREA REQUIRED; REQUIRING COMMON AREA, <br />A PORTE COCHERE, AND GARAGE STRUCTURES TO BE <br />HARMONIOUS WITH THE PRIMARY STRUCTURE; CLARIFYING <br />PARKING LOCATIONS; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the Seminola Boulevard (SB -2) Overlay District (SBOD) Design Guidelines with land use <br />regulations were approved via Ordinance 02 -1071 on December 9, 2002, including Exhibit B, and codified <br />into the Unified Land Development Regulations in Section 2 -7.26; and <br />WHEREAS, residential land uses are desired throughout the entirety of the Seminola Boulevard <br />Overlay District (SBOD) and the elimination of the "Commercial' designation provided within Exhibit B is no <br />longer required rendering "Exhibit B" as unnecessary; and <br />WHEREAS, the SB -2 Overlay Zoning District Design Guidelines includes criteria for Assisted and <br />Independent Living Facilities that conflict with the new criteria established by the adoption of Ordinance 15- <br />1420, creating ULDR Section 2 -7.33, Assisted Living Facilities; and <br />WHEREAS, words with double underlined type shall constitute additions to the original text and &t6ke <br />through shall constitute deletions to the original text. <br />NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of Casselberry, <br />Florida: <br />SECTION 1. That Section 2- 7.26.B., Definitions, Part III Unified Land Development Regulations, <br />Chapter II District and General Regulations, Article VII, General Regulations, of the Code of Ordinances of <br />the City of Casselberry, Florida shall be amended as follows: <br />
