ORDINANCE 15 -1420 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; AMENDING THE CITY OF CASSELBERRY CODE OF ORDINANCES, PART III, SECTION 5 -21.2, "DEFINITIONS," TO ADD "ASSISTED LIVING FACILITY," "INDEPENDENT LIVING UNITS," "KITCHENETTE," "MEMORY CARE FACILITY," AND "RESIDENTIAL SUITE;" CHANGE "NURSING HOME (REST HOMES AND CONVALESCENT HOMES);" AND TO DELETE "EXTENDED CARE FACILITY;" AMENDING PART III, ARTICLE V, "ZONING DISTRICT REGULATIONS," TO INCLUDE "ASSISTED LIVING FACILITIES" IN TABLE 2 -5.3 "LAND USE BY DISTRICT" AND AMENDING THE TITLE FOR "NURSING HOMES (REST HOMES AND CONVALESCENT HOMES);" AMENDING PART III, ARTICLE V, "ZONING DISTRICT REGULATIONS," TABLE 2 -5.4, "SIZE AND DIMENSION REGULATIONS," TO INCLUDE A FOOTNOTE PROVIDING A REFERENCE TO SECTION 2 -7.33 FOR ASSISTED LIVING FACILITY CRITERIA; AMENDING PART III, ARTICLE VII, "GENERAL REGULATIONS," TO CREATE SECTION 2 -7.33 TO PROVIDE CRITERIA FOR ASSISTED LIVING FACILITIES SUCH AS MINIMUM LIVING SPACE, DENSITY CALCULATION, PARKING REQUIREMENTS, AND OTHER DESIGN REQUIREMENTS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, Part III, Unified Land Development Regulations, of the Code of Ordinances of the City of Casselberry, Florida does not include Assisted Living Facility as a land use category; and WHEREAS, the City seeks to provide regulations for Assisted Living Facilities; and WHEREAS, new definitions are required to describe Assisted Living Facilities and the uses within; and WHEREAS, it is necessary to provide a density calculation for Assisted Living Facilities due to the low impact these facilities have on traffic and the surrounding areas; and WHEREAS, it is necessary to provide other criteria for Assisted Living Facilities; and WHEREAS, a revised definition of Nursing Homes (including rest homes and convalescent homes) is provided to describe the uses within; and WHEREAS, words with double underlined type shall constitute additions to the original text and &t46 through shall constitute deletions to the original text. NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of Casselberry, Florida:
