Section 58 -203. Remedies. <br />1. Each person that holds or controls a human commercial advertising sign in <br />violation of Chapter 58 shall be responsible for a civil fine and penalty of (a) $100 for a <br />first violation, and (b) $500 for any subsequent violation of Chapter 58. <br />2. All designated Code Enforcement Officers are authorized to issue a <br />citation to a person when, based upon personal investigation, the Code Enforcement <br />Officer has reasonable cause to believe that the person has committed a violation of <br />Chapter 58. A warning notice is not required for the issuance of a citation for a violation <br />of Chapter 58. <br />3. The procedures to pay for and contest citations as set forth in Section 2- <br />211 of the Code are incorporated herein, with the exception that the civil penalties shall <br />be as set forth in 58- 203.1. <br />4. In addition to the remedies set forth above, Chapter 2 (Administration), <br />Article V (Code Enforcement Citations) shall remain a supplemental and additional <br />method of enforcing this Chapter 58. <br />SECTION II. Section 2 -210 (a), Schedule of violations, of Article V, Code <br />Enforcement Citations, of Chapter 2, Administration is hereby amended to read as follows: <br />Section 2 -210 Schedule of violations. <br />(a) Violation of the following City codes or ordinances is a civil infraction for which <br />a citation shall be issued: <br />General City Code <br />Code Section Description of Violation Classification <br />58 -202 Nuisance through temporary display of <br />commercial signs on public property Class II <br />SECTION III. CODIFICATION. It is the intention of the City Commission of the <br />City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall <br />become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the <br />Sections of this Ordinance may be renumbered or re- lettered to accomplish such intention; that <br />the word, "Ordinance" may be changed to "Section," "Article," or other appropriate word. <br />SECTION IV. CONFLICTS. All Ordinances or parts of Ordinances in conflict with <br />any of the provisions of this Ordinance are hereby repealed. <br />
