Section 58 -203. Remedies. 1. Each person that holds or controls a human commercial advertising sign in violation of Chapter 58 shall be responsible for a civil fine and penalty of (a) $100 for a first violation, and (b) $500 for any subsequent violation of Chapter 58. 2. All designated Code Enforcement Officers are authorized to issue a citation to a person when, based upon personal investigation, the Code Enforcement Officer has reasonable cause to believe that the person has committed a violation of Chapter 58. A warning notice is not required for the issuance of a citation for a violation of Chapter 58. 3. The procedures to pay for and contest citations as set forth in Section 2- 211 of the Code are incorporated herein, with the exception that the civil penalties shall be as set forth in 58- 203.1. 4. In addition to the remedies set forth above, Chapter 2 (Administration), Article V (Code Enforcement Citations) shall remain a supplemental and additional method of enforcing this Chapter 58. SECTION II. Section 2 -210 (a), Schedule of violations, of Article V, Code Enforcement Citations, of Chapter 2, Administration is hereby amended to read as follows: Section 2 -210 Schedule of violations. (a) Violation of the following City codes or ordinances is a civil infraction for which a citation shall be issued: General City Code Code Section Description of Violation Classification 58 -202 Nuisance through temporary display of commercial signs on public property Class II SECTION III. CODIFICATION. It is the intention of the City Commission of the City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be renumbered or re- lettered to accomplish such intention; that the word, "Ordinance" may be changed to "Section," "Article," or other appropriate word. SECTION IV. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed.
