NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of <br />Casselberry, Florida: <br />SECTION I. That a new article entitled "Nuisances through the Temporary Display of <br />Certain Commercial Signs Directed to Passing Motorists fi-om Public Property and Public Rights <br />of Way" shall be added to Chapter 58, Offences, Public Nuisances, and Miscellaneous <br />Provisions, of the Code of Ordinances of the City of Casselberry, Florida as follows: <br />CHAPTER 58. ARTICLE VIII. NUISANCES THROUGH THE TEMPORARY <br />DISPLAY OF CERTAIN COMMERCIAL SIGNS DIRECTED TO PASSING <br />MOTORISTS FROM PUBLIC PROPERTY AND PUBLIC RIGHTS OR WAY. <br />Section 58 -201. Definitions. <br />For the purposes of this Article, the following definitions shall apply: <br />1. Human commercial advertising sign. A commercial sign held or controlled by <br />human sign spinners while standing, sitting or lying down on public property or on public <br />rights of way, where a commercial advertising sign message is directed or otherwise <br />oriented in whole or in part to passing motorists and vehicular traffic transiting nearby on <br />an adjoining street or highway. <br />2. Human sign spinner. A person that holds or controls a commercial advertising <br />sign and who waves, twirls, spins or otherwise uses some form of action or movement to <br />attract the attention of any passing motorist or vehicular traffic to any commercial <br />advertising message that is displayed on the sign. <br />3. Commercial advertising sign. A commercial advertising sign is an advertising <br />sign that directs attention to a commercial activity, commercial product, commercial <br />business, commercial service, commercial event or commercial activity conducted, sold <br />or offered for sale on private property. <br />Section 58 -202. Violation. <br />1. Violation. It shall be unlawful and a violation of Chapter 58 for a human sign <br />spinner to display a human commercial advertising sign while standing or sitting on <br />public property or on public rights of way, where a commercial advertising sign message <br />is directed or otherwise oriented in whole or in part to passing motorists and vehicular <br />traffic transiting nearby on an adjoining street or highway. <br />2. Separate violation. Each day that a violation of Chapter 58 occurs at a location <br />on public property or on public rights of way shall be deemed a separate violation for <br />purposes of the remedies set forth herein. If a violation of Chapter 58 occurs on the same <br />day at a location on public property or on public rights of way that is more than one <br />hundred feet from any other location where a violation of Chapter 58 has occurred on the <br />same day, then the violation shall be considered a separate violation for the purpose of <br />the remedies set forth herein even though the violation occurred on the same day. <br />
