CITY COMMISSION March 1, 1993 Page 7 Commissioner Henson stated he wanted to specifically address building heights, and suggested allowing heights to exceed 35 ft. in certain areas such as Seminole Plaza. Vice Mayor Robertson stated he was an advocate of the suggestion as well. Mr. Harley suggested having a conditional use permit for buildings in excess of 35 ft., but still have a maximum for those buildings as a safeguard procedure. Mr. Schluckebier suggested that building heights higher than 35 ft. could be allowed subject to the recommendation of the Planning and Zoning Commission in those areas designated as high- intensity /non - residential on the Future Land Use Map, and all other areas would be subject to a conditional use permit. Mr. Harley requested that the Community Development Department be allowed to conduct a special study and return some specific recommendations to the Commission within a six week period. Mr. McIntosh recommended implementing the modification of Table 2 -5.4, as noted in Michael Delk's memorandum dated February 11, 1993. (A copy of Mr. Delk's memorandum is attached to these minutes.) The Commission agreed with Mr. McIntosh's recommendation. Mr. McIntosh was opposed to Mr. Ritter's letter dated January 25, 1993 regarding the termination of non - conforming uses, stating the City might be subject to an inverse condemnation suit for confiscation of property without compensation. (A copy of Mr. Ritter's letter is attached to these minutes.) The Commission directed Mr. Harley to address non - conforming uses along with building heights and return that information to the Commission within six weeks. MOTION: Mr. Robertson moved, Mr. Henson seconded, and motion carried unanimously to approve and adopt Ordinance 757 on second and final reading, subject to the modification of Table 2- 5.4 as outlined in Michael Delk's February 11, 1993 memorandum; and subject to specific approval by the City Commission of appendices regarding building heights and non - conforming uses to be issued within the next six weeks from the Community Development Department. The Commission was polled on the motion as follows: Mr. Henson - Yes; Mr. McMullen - Yes; Mr. Sheppard - Yes; Mr. Robertson - Yes; Mr. Hillebrandt - Yes. Motion carried 5 - 0. The Mayor closed the Public Hearings.
