CITY COMMISSION <br />March 1, 1993 <br />Page 7 <br />Commissioner Henson stated he wanted to specifically address building heights, and suggested <br />allowing heights to exceed 35 ft. in certain areas such as Seminole Plaza. Vice Mayor Robertson <br />stated he was an advocate of the suggestion as well. <br />Mr. Harley suggested having a conditional use permit for buildings in excess of 35 ft., but still <br />have a maximum for those buildings as a safeguard procedure. Mr. Schluckebier suggested that <br />building heights higher than 35 ft. could be allowed subject to the recommendation of the <br />Planning and Zoning Commission in those areas designated as high- intensity /non - residential on <br />the Future Land Use Map, and all other areas would be subject to a conditional use permit. <br />Mr. Harley requested that the Community Development Department be allowed to conduct a <br />special study and return some specific recommendations to the Commission within a six week <br />period. <br />Mr. McIntosh recommended implementing the modification of Table 2 -5.4, as noted in Michael <br />Delk's memorandum dated February 11, 1993. (A copy of Mr. Delk's memorandum is <br />attached to these minutes.) The Commission agreed with Mr. McIntosh's recommendation. <br />Mr. McIntosh was opposed to Mr. Ritter's letter dated January 25, 1993 regarding the <br />termination of non - conforming uses, stating the City might be subject to an inverse condemnation <br />suit for confiscation of property without compensation. (A copy of Mr. Ritter's letter is <br />attached to these minutes.) The Commission directed Mr. Harley to address non - conforming <br />uses along with building heights and return that information to the Commission within six weeks. <br />MOTION: Mr. Robertson moved, Mr. Henson seconded, <br />and motion carried unanimously to approve and <br />adopt Ordinance 757 on second and final <br />reading, subject to the modification of Table 2- <br />5.4 as outlined in Michael Delk's February 11, <br />1993 memorandum; and subject to specific <br />approval by the City Commission of appendices <br />regarding building heights and non - conforming <br />uses to be issued within the next six weeks from <br />the Community Development Department. <br />The Commission was polled on the motion as follows: <br />Mr. Henson - Yes; Mr. McMullen - Yes; Mr. Sheppard - Yes; Mr. Robertson - Yes; <br />Mr. Hillebrandt - Yes. Motion carried 5 - 0. <br />The Mayor closed the Public Hearings. <br />
