contribution as determined by the actuary employed by CITY's Pension Board of Trustees and as <br />otherwise provided for by state law or by ordinance of CITY. At no time will COUNTY be <br />required to contribute to any CITY pension plan at a rate greater than the employer contribution <br />rate then required by the FRS for similarly classified employees. <br />(4) FRS Contributions. The parties agree that should a Transferred Employee <br />elect to join the FRS, COUNTY shall make the required employer contribution to the FRS. <br />(5) FRS Past Service Credit. COUNTY will not finance or otherwise pay for <br />the "past service" credit for Transferred Employees as defined by the FRS and as authorized <br />under Chapter 121, Florida Statutes (2014), as the statute may be amended from time to time. <br />(e) Employment Right of Control. COUNTY shall have and maintain all <br />responsibility for and control over the delivery of services, standards of performance, discipline <br />of personnel and other matters incident to, the, performance of the services, duties, and <br />responsibilities described and contemplated in this Agreement, including the determination of <br />wages and benefits for Transferred Employees. <br />(f) Assignment of Personnel. COUNTY agrees to transfer CITY employees <br />identified on Attachment "A" to the initial COUNTY organization structure depicted on <br />Attachment "B." COUNTY may alter assignments in the future consistent with COUNTY <br />policies, procedures, and organizational needs. <br />(g) Worker's Compensation. COUNTY agrees to cover all costs for worker's <br />compensation insurance for Transferred Employees effective October 1, 2015. Any worker's <br />compensation claims made prior to October 1, 2015 will remain the responsibility of CITY. Any <br />worker's compensation claims made by Transferred Employees related to accidents and injuries <br />within the course and scope of employment with CITY will remain the responsibility of CITY in <br />Fire and Emergency Medical Services Interlocal Agreement <br />Seminole County / City of Casselberry <br />Page 7 of 20 <br />
