compensation fund pursuant to Chapter 440, Florida Statutes (2014), as this statute may be <br />amended from time to time, vacation or compensatory time, sick leave benefits, or other <br />amenities of employment to any COUNTY personnel performing services, duties and <br />responsibilities under this Agreement for the benefit of CITY and its residents or any other <br />liabilities whatsoever, unless specifically provided to the contrary in this Agreement. Except as <br />provided for elsewhere in this Agreement, CITY is not liable for benefits, or compensation <br />accrued on behalf of any Transferred Employee while employed by COUNTY, nor is CITY <br />liable for compensation, contribution, or indemnity to COUNTY of any kind whatsoever, arising <br />out of such employment and performance of the services, duties, and responsibilities <br />contemplated in this Agreement. <br />(5) No Joint Employment. Under no circumstances and for no purpose will <br />CITY and COUNTY be deemed joint employers of Transferred Employees. Moreover, this <br />Agreement must always be construed to be consistent with this consideration and requirement. <br />(b) Time in Grade. COUNTY agrees and acknowledges that the length of service and <br />time in grade earned by a Transferred Employee while a CITY employee will transfer to <br />COUNTY system. Transferred Employees' date of hire or appointment with CITY Fire <br />Department will be considered their date of hire or appointment with COUNTY Public Safety <br />Department. <br />(c) Rate of Pay. Commencing October 1, 2015, COUNTY shall pay each <br />Transferred Employee a base salary or wage that will provide each Transferred Employee the <br />same pay provided by CITY as of June 1, 2015, provided it does not exceed the maximum pay <br />within the pay band for COUNTY's similar positions. If the pay of the Transferred Employee <br />exceeds the maximum of COUNTY pay band for that position, the Transferred Employee will be <br />Fire and Emergency Medical Services Interlocal Agreement <br />Seminole County / City of Casselberry <br />Page 5 of 20 <br />
