(i) Pre - Employment Fitness for Duty Physical Examination. All Transferred <br />Employees shall take and pass the same pre- employment fitness for duty physical examination <br />that is taken by all other COUNTY Fire/EMS job applicants. This physical examination will <br />include an examination for all disabilities and diseases specified in Sections 112.18 and 112.181, <br />Florida Statutes (2014), which give rise to the presumption that such disabilities and diseases <br />were incurred in the line of duty. No applicant will be accepted as a Transferred Employee who <br />has at the time of the examination any such disability (either partial or total) or disease specified <br />in these statutes, unless a reasonable accommodation can be made for such applicant to continue <br />in the same line of duty despite such disease or disability. For any such applicant for whom a <br />reasonable accommodation can be made, CITY shall be responsible for workers' compensation <br />expenses that are associated with the respective disability or disease diagnosed and documented <br />while in CITY employ. CITY shall document all such expenses on the Effective Date of this <br />Agreement. <br />0) Pending Claims. CITY represents no employee listed in Attachment "A" has any <br />pending and unresolved claim against CITY, including, but not limited to, claims of any nature <br />related to alleged discrimination, pay, overtime, benefits, or for any other matter. <br />Section 4. Financial Considerations. <br />(a) Fire Fees: <br />(1) Rates. CITY agrees to implement COUNTY's Fire/Rescue Municipal <br />Services Taxing Unit (MSTU) effective October 1, 2015 and as the MSTU millage rate may be <br />revised from time to time (also described as "Fire Fees" below). CITY's initial implementation <br />of the MSTU millage rate must be in a manner that is revenue neutral with respect to the <br />aggregate millage rates that CITY residents pay collectively to CITY and COUNTY.
