RESOLUTION 94 -835 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, WHEREBY <br />THE CASSELBERRY CITY COMMISSION ISSUES A DECLARATION OF <br />NECESSITY, FINDING BLIGHT IN AND ADJACENT TO THE CITY [REF. <br />163.355, F.S.], AND AUTHORIZES THE CREATION OF A COMMUNITY <br />REDEVELOPMENT AGENCY /TAXING AUTHORITY TO FORMULATE AND <br />ADMINISTER A WORKABLE PROGRAM TO ELIMINATE, REMEDY, AND <br />PREVENT THE FURTHERANCE OF BLIGHTED CONDITIONS IN AND <br />ADJACENT TO THE CITY; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND AN EFFECTIVE DATE. <br />WHEREAS, there exist within and adjacent to the City of Casselberry blighted areas; and <br />WHEREAS, a "blighted area" in or adjacent to Casselberry is an area in which there exist <br />substantial slum structures or conditions, or an area in which one or more of the following factors <br />substantially impair and arrest the sound growth of Casselberry: <br />A predominance of defective or inadequate street layouts; <br />2. Faulty lot layouts in relation to size, adequacy accessibility, or usefulness; <br />3. Unsanitary and unsafe conditions such as inadequate infrastructure, unsafe ingress /egress <br />or other traffic hazards; <br />4. Deterioration of site or other improvements; <br />5. Tax or special assessment delinquencies exceeding the fair value of the land; and <br />6. Diversity of ownership, or defective or unusual conditions of title which prevent the free <br />alienability of land within the deteriorated area, or hazardous areas which have faulty or <br />inadequate street layout, or inadequate parking facilities, inadequate roadways, bridges <br />or public transportation facilities incapable of handling the volume of traffic flow into or <br />through the area, either at present or following proposed construction, <br />WHEREAS, blight imposes an onerous burden on the people of Casselberry and Seminole <br />County, impairing and arresting sound economic growth, aggravating traffic hazards, preventing the <br />improvement of traffic roadway facilities, and constituting a serious and growing menace injurious to <br />public health, safety, morals, and welfare of the residents of Casselberry and of Seminole County; and <br />WHEREAS, the existence of economically underutilized blighted areas contributes to the spread <br />of disease and crime and constitutes an economic and social liability for the citizens of Casselberry and <br />of Seminole County; and <br />WHEREAS, the City Commission appointed a Casselberry Central Business District Committee <br />to study slum and blight, and the Committee, with the assistance of Casselberry Community Development <br />Department staff, identified areas with a concentration of conditions of this type, and made a preliminary <br />determination of boundaries to encompass a "Casselberry Central City District Community Redevelopment <br />Area" within which these conditions exist; and caused those boundaries to be depicted on a Central City <br />District Map; and <br />
