SECTION 2. The City Commission hereby approves the Utility Maintenance Agreement <br />and authorizes the Mayor to execute said document on behalf of the City. <br />SECTION 3. The City Commission further requires the applicant to meet the remaining <br />conditions of approval provided by the Planning and Zoning Commission at their November 13, <br />2013 and additional requirements as stated below: <br />1. The applicant, per F.S. Chapter 177, is responsible for the surveyor and City Attorney fees. <br />The applicant is also responsible for Seminole County recording fees. <br />2. The `Consent and Joinder' agreement, Utility Maintenance Agreement and written consent <br />of trustees shall be recorded prior to recording the plat. Reference to these agreements <br />shall be made on the plat prior to the plat being recorded. <br />After City Commission approval, the applicant shall provide one (1) mylar of the recorded <br />plat executed by the owner, surveyor, and any other information requested as part of <br />compliance to F.S. Chapter 177. <br />SECTION 4. Conflicts. All resolutions or parts of resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION 5. Severability. If any section or portion of a section of this Resolution proves <br />to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force or effect of any other section or part of this Resolution. <br />SECTION 6. Effective Date.
