Under the <br />jurisdiction of the St John's Water Management it's perfectly ok. Respondents composite exhibit A and B, <br />were entered into evidence. <br />Mr. Flagiello stated the area has been replanted, just not the ones requested by the City Engineer <br />The Special Magistrate asked if there was anyone else wishing to speak on this matter. <br />Jason Sorensen, planner for City of Casselberry referred to the site plan, Mr. Sorensen could see it listed as a <br />conservation area but did not see where it has a dock listed on there. Mr. Sorensen advised that docks are a <br />conditional use in many of the zoning districts, there is not one zoning district where a dock is outright <br />permitted. <br />The Special Magistrate asked, if everything was planted that was recommended by the Engineer and the dock <br />is still there, then it's still in violation. <br />Mr. Sorensen stated yes. <br />The Special Magistrate advised Mr. Teolis that it's the City's intention that the dock is still considered non- <br />compliant. If everything is planted and restored and the dock (platform) is still there it would still be in non- <br />compliance. <br />Mr. Teolis stated the above is according to the City, St Johns said the waters are owned by the Citizens of <br />Florida. <br />The Special Magistrate stated this is a dispute of jurisdiction. <br />Mr. Sorensen stated he has processed several docks with conditional uses since he has been with the City 3.5 <br />years, at no time has this come up where St Johns said a conditional use can't be required for a dock. <br />Rodney Dawson, 2638 Ultra Vista Dr stated there has been nothing but dead tree removal from this land. <br />FINDING OF FACT: The Special Magistrate made a finding in for the above cases, that there appears to be <br />no factual dispute that to modify the land as depicted in the photographs required a permit from the City of <br />Casselberry and no permit was granted. The order is 30 days to comply of 5/10/2014 or a $25.00 per day per <br />violation fine will accrue. Finding for case CE -14 -00027 order modified to 60 days or 6/8/2014. <br />No building permit, City Code Section 1 -4.3 <br />0 CE -14 -00144 231 Colony Dr <br />Officer Hull gave testimony for the above case. The property was inspected after a citizen complaint on <br />2/11/2014. The resident met with Mr. Hull and advised they were just pouring a concrete slab. The resident <br />was advised to come to City Hall and see the building department and explain everything he was doing to see <br />what he needs permits for. <br />Mr. Hull stated that from N Winter Park Dr he could see walls being erected. The resident came in and spoke <br />with Debra in the building department and was referred to Altamonte Springs, which we contract our building <br />department services with. Permits were needed for windows and moving a shed. <br />On 4/7/2014 a permit was applied for, for the shed and as of 4/10/14 was in the review process. On 4/10/14 <br />Mr. Hull inspected the property and could see more ongoing work, it appears they are putting in an outdoor <br />kitchen, with a sink and a different concrete structure and in the front a gate between the house and original <br />fence.
