Officer Hull advised that this property was in violation for 56 days at $25.00 per day, total amount due is <br />$1,400.00. This violation was by the former owner. The current owner is requesting reduction of the lien. The <br />City recommends a reduction of the lien to $350.00, due to the current owner taking back the property and <br />was not aware of the violation. Green card was signed for by current owner on 3/17/14 and property was in <br />compliance on 3/20/14. <br />The Special Magistrate asked in the property owner was ok with this reduction. <br />Santiago De Juan, property owner stated he was ok with this reduction. <br />The Special Magistrate asked, is there was anyone else wishing to speak. There was no one. <br />FINDING OF FACT: The Special Magistrate made a finding that the property at 1741 Lake Dr was in <br />violation but has since come into compliance. The fine of $1,400 was proper based on mitigating <br />circumstances and the reduction to $350 is also proper. No motion was <br />made. <br />NEW CASES <br />No building permit, City Code Section 1 -4.3 <br />• CE -13 -01309 2638 Cayman Way <br />Officer Hernandez gave testimony for the above case. The property was originally inspected by Officer Hull on <br />December 3, 201. The property was cited on December 6, 2014 under code 1 -4.3, no building permit. It was <br />observed that existing dividing walls were raised, the patio roof line had been extended and in the process of being <br />enclosed. The permit application was denied by Jason Sorensen on March 5, 2014. Property was inspected on April <br />10, 2014 and the enclosure was finished. It was requested to give the property owner 14 days to come into <br />compliance or a $25 per day fine will begin to accrue. <br />The Special Magistrate asked what the City considered to be compliance. <br />Mr. Hernandez stated compliance would be having to be brought down due to the permit being denied. <br />Jason Sorensen, Planner for City of Casselberry advised certificate of occupancy was given on August 10, 1977, at <br />the time zoning was R -3, at that time the structure would need to be in a 20ft rear setback (Composite Exhibit A). <br />The property was later zoned RMF- 13which Mr. Sorensen added to Exhibit A as well as the current zoning map, also <br />the land use by table showing the setback should be 30ft. The property now requires a 30ft setback for homes in the <br />RVIF -13 zoning district, which makes most of the units at that location non - conforming, which can't be altered, <br />HIM I <br />
