however, outstanding portions of the project were not constructible as designed and these areas were <br />removed from the project; and <br />WHEREAS, Killebrew, Inc. has submitted Change Order No. 8 as a net deductive change order that <br />reduces the overall project cost by $185,310.14, which will bring the Water Quality Improvement Projects to <br />a close; and <br />WHEREAS, City staff and the City's technical consultant have reviewed Change Order No. 8 <br />submitted by Killebrew, Inc. and have found it adequate to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberty hereby approves Final Change Order <br />No. 8 to the agreement with Killebrew, Inc. for the City's Water Quality Improvements Projects for an <br />amount of $185,310.14, and authorizes the Mayor to execute said document on behalf of the City. <br />SECTION IL Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part of this Resolution. <br />SECTION IV.
