RESOLUTION 14 -2598 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF CHANGE ORDER NO. 8 TO THE CONSTRUCTION AGREEMENT WITH KILLEBREW, INC. FOR OVERRUNS AND UNDERRUNS ENCOUNTERED ON PHASE 3 OF THE WATER QUALITY IMPROVEMENTS PROJECTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, in September 2009, the Florida Department of Environmental Protection (FDEP) awarded the City $3 million in stimulus grant and loans related to the American Recovery and Reinvestment Act to cover the costs associated with the construction of water quality improvement project areas throughout the City's water distribution system; and WHEREAS, via Resolution 10 -2107, Killebrew, Inc. was selected under a competitively bid process to construct the City's water quality improvement project areas; and WHEREAS, via Resolution 10 -2111, the City Commission approved Change Order No. 1 with Killebrew, Inc. which added an additional project area to the list of approved projects; and WHEREAS, via Resolution 11 -2221, the City Commission approved Change Order No. 2 with Killebrew, Inc. in the amount of $2,726,923 to construct additional water quality improvement project areas; and WHEREAS, via Special Invoice Report on April 11, 2011, the City Commission approved Change Order No. 3 with Killebrew, Inc. which removed one project area and added two project areas to the list of approved projects and resulted in no cost increase or decrease to the contract; and WHEREAS, via Resolution 12 -2339, the City Commission approved Change Order No. 4 with Killebrew, Inc. which added Project Area 14 -B and 14 -C to the contract and removed Project Area 9 - Lake Katluyn 1 for a cost increase of $30,647.08 and an additional 76 contract days; and WHEREAS, via Resolution 12 -2366, the City Commission approved Change Order No. 5 with Killebrew, Inc. which added Phase 3 of the Water Quality Improvement Projects for a cost increase of $3,556,408.20 and an additional 548 contract days; and WHEREAS, via Resolution 13 -2506, the City Commission approved Change Order No. 6 with Killebrew, Inc. to consolidate overruns for Phase 3 for a cost increase of $315,948.75 and an additional 121 contract days; and WHEREAS, via Resolution 13 -2556, City Commission approved Change Order No. 7 with Killebrew, Inc. in the amount of $154,018.32, which balanced the additional areas of overruns and underruns at that time encountered within the project areas; and WHEREAS, while continuing construction of Phase 3 of the Casselberry Water Quality Improvement Projects, additional areas of overruns and undet7uns have been encountered on the project;
