Planning & Zoning Commission( <br />Local Planning Agency <br />November 13, 2013 <br />Page 2 <br />Fourth Item of Business: CU 13 -12: 3450 S US Highway 17-92/Lake Ellen Church. Conditional use request to <br />allow a daycare in association with a Church. <br />Ms. Regan stated that the applicant has withdrawn CU 13 -12. <br />Ms. Regan discussed the following agenda items together. <br />Fifth Item of Business: CU 13.13: 1815 SR 436/Aloma Baptist Church. Conditional use request to allow a <br />Fellowship Hall in association with a new facility. <br />Sixth Item of Business: SP 13 -01: Aloma Baptist Church Replat. A replat of 5 parcels into 1 parcel totaling <br />9.13 acres. Property located at 1815 State Road 436. <br />Seventh Item of Business: ZB 13 -02: Rezoning — Small Scale Amendment; 1815 SR 436. Amend the zoning <br />classification of 5 parcels of land totaling approximately 9.13 acres to Planned Mixed -Use — Medium Rise <br />(PMX -MID) at 1815 State Road 436. <br />Marie Regan, Planner II, explained that Aloma Baptist Church has applied for a conditional use for a <br />Fellowship Hall, a replat of parcels, and a rezoning. Ms. Regan reviewed the information provided in her memos <br />dated November 13, 2013, to the City of Casselberry Planning and Zoning Commission (copies are on file in the <br />Community Development Department). Ms. Regan explained that Aloma Baptist Church has purchased three <br />parcels that they want to incorporate with their property. She said this will require re- platting the parcels and then <br />rezoning the replaced parcel to a Planned Mixed Use — Medium Rise (PMX -MID) designation. <br />Ms. Regan said upon review of the Conditional Use request, the Planning and Zoning Commission's <br />approval of CU 13 -13 to allow development of a fellowship hall at 1815 State Road 436, should be based on the <br />findings of fact and conclusions of the staff report dated November 13, 2013, and the following conditions: <br />1. The Conditional Use shall be limited to the location of 1815 State Road 436. <br />2. The Conditional Use shall be limited to the building of the fellowship hall as provided in the attached site <br />plan as Exhibit B to the staff report. <br />3. The fellowship hall shall be restricted to church related uses. Any use of church property which requires <br />additional parking or which will create additional noise or any other related impact to the property or <br />surrounding property shall require an additional conditional use process. <br />4. Development shall comply with the general regulations for Churches 2 -7.25. <br />5. A modification to the setback requirements in section 2 -7.25 of the Code will be required at the time of <br />site plan approval. <br />6. All site lighting shall meet the requirements of Section 3 -10.2 of the City's Unified Land Development <br />Regulations. <br />7. Noise shall not exceed the levels indicated in Section 3 -17.4 of the City's Unified Land Development <br />Regulations. <br />8. Where possible existing trees should be retained; any trees removed from the site as a result of <br />development shall be replaced in kind. <br />
