He felt that a paid magistrate would eliminate the community working with the <br />community. <br />Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry <br />didn't recommend using an attorney for the special magistrate. He said he didn't feel an attorney was helpful to <br />anyone but the government in the code enforcement processes because all they really do is interpret the law. He <br />said a judge can actually make a decision. Mr. Casselberry recommended using a licensed mediator for code <br />enforcement issues. <br />Mr. Casselberry said what he has seen in the code enforcement process that the fines accrue very fast and <br />end up being more expensive than the actual repairs. <br />A general discussion ensued regarding the use of an attorney as a special magistrate, code enforcement <br />board made up of City residents, number of vacancies on the Code Enforcement Board, difficulty in filling the <br />vacancies on the board, favorable comments from other cities in the area that use a special magistrate and <br />consistency in the enforcement process. <br />A brief discussion ensued regarding the difficulty in enforcing parking of commercial vehicles in a residential <br />area. Ms. Smith explained that the code enforcement process is a very lengthy process and sometimes you cannot <br />get compliance. In response to the Commission's question regarding a fine schedule, Ms. McKinney said Code <br />Enforcement is required to follow the Florida Statutes in determining fines and notice requirements. <br />Mr. Meadows asked for a motion to address LPA 13 -11. Mr. Wadley made a motion that the Planning and <br />Zoning Commission provide a favorable recommendation to the City Commission for LPA 13 -11 to amend the City of <br />Casselberry Code of Ordinances, Part II and Part III, to eliminate redundant code language related to citations and to <br />provide new language to include a special magistrate into the City's code enforcement process as provided in the <br />attached draft ordinance.
