Planning & Zoning Commission/ <br />Local Planning Agency <br />October 9, 2013 <br />Page 3 <br />Sixth Item of Business: BA 13.05: 708 Lake Howell Road. A variance to ULDR Section 2- 7.10(C) to allow a 6 foot <br />fencelwall 85 feet forward of the main structure. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated October 9, 2013, to <br />the City of Casselberry Planning and Zoning Commission. <br />Mr. Weinroth disclosed that he has known the Rabbi and his wife for several years. <br />Mr. Sorensen presented a PowerPoint presentation (a copy is attached and made a part of the minutes). He said <br />the applicant does did not meet all 6 criteria to grant a variance; therefore, staff recommends denial of an 85 foot variance, <br />Mr. Sorensen said staff would be supportive of an approximately 62 foot variance as it would then meet the criteria for the <br />minimum variance granted. <br />Mr. Sorensen said if the Planning and Zoning Commission chooses to grant a variance for a 6 foot fence with <br />stucco columns for BA 13 -05, for the property located at 708 Lake Howell Road, the motion should be based upon the <br />Planning and Zoning Commission's findings of fact and conclusions, the staff report dated October 9, 2013, the property <br />survey attached as Exhibit B to the staff report, and the following conditions: <br />1. The fence shall not be erected forward of the front facade of the adjacent structure to the ne4 south. <br />2. The fence and columns shall not exceed six feet in height and shall not be enlarged in any way. <br />3. The fence shall be maintained in good repair and the good side must face out or the variance will become null <br />and void. <br />4. The fence shall be decorative aluminum and the columns shall be decorative stucco or brick. <br />5. Shrubs shall be located directly in front of the fence to be planted at a minimum height of 24" and spacing of 3 <br />feet maximum. A landscape plan shall be submitted and approved by staff. <br />6. All of the above conditions shall be fully and faithfully executed or the variance shall become null and void. <br />Mr. Sorensen stated that condition number 1 was changed from north to south. In response to the Commission's <br />question, Mr. Sorensen stated that the proposed fence is designed to allow a vehicle to pull into the driveway <br />without having to stop on the roadway to open the gate. A brief discussion ensued regarding the loss of two <br />parking spaces with the applicant's design of the proposed fence. <br />Mr. Meadows asked the applicant to come forward. Mr. Sholom Dubov, Executive Director of Chabad Lubavitch of <br />Greater Orlando, 708 Lake Howell Road, Maitland, Florida came forward. Mr. Dubov said they have been in the community <br />since 1984. He said the property was originally a residential property and it was given exception so congregates could walk <br />to the synagogue.
