Planning & Zoning Commission/ <br />Local Planning Agency <br />October 9, 2013 <br />Page 2 <br />Fifth Item of Business: CU 13.10: 515 Queens Mirror Circle /F. Tunnissen. A revision to a previously approved <br />conditional use to allow a 44 foot dock in a residential district. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated October 9, 2013, to <br />the City of Casselberry Planning and Zoning Commission. Mr. Sorensen explained that this item was originally presented to <br />the Planning and Zoning Commission at the September 11, 2013 meeting. He said at that meeting staff presented a <br />conditional use request for a 34' long dock and it should have been for a 44' long dock. <br />Mr. Sorensen presented a PowerPoint presentation (a copy is attached and made a part of the minutes). He said <br />staff finds that the proposed use is compatible with the surrounding land uses. Mr. Sorensen said staff recommends <br />approval of the replacement of the existing dock in the same location. He said if the Planning and Zoning Commission <br />chooses to approve the revision to CU 13 -10 to allow a 44' long private residential dock at 515 Queens Mirror Circle, the <br />motion should be based on the staff report dated October 9, 2013, the site drawing (Exhibit A), the Planning and Zoning <br />Commission's findings of fact, and the following conditions: <br />1. The conditional use shall be limited to the proposed dock structure. The dock shall not be enlarged or <br />enhanced in any way without additional conditional use approval by the Planning and Zoning <br />Commission. <br />2. The construction and maintenance of the dock shall be in accordance with the requirements of all <br />applicable state agencies, the City Engineer's conditions of approval, and the City's ULDR. <br />3. The applicant shall incorporate dock lighting into the plans prior to submitting for a building permit. This <br />lighting shall illuminate the entire length of the dock as required by Section 94 -6. <br />4. A building permit for the dock shall be obtained within 90 days of the approval and a final inspection shall <br />be obtained within 180 days of the issuance of the building permit. <br />5. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />The applicant was not present at the meeting. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Meadows asked for a motion to address CU 13 -10. Mr. Bryan made a motion to approve the revision to CU 13- <br />10 to allow a 44' long private residential dock at 515 Queens Mirror Circle based on the staff report dated October 9, 2013, <br />the site drawing attached as Exhibit A to the staff report and the five conditions of approval outlined in the staff report. Mr. <br />Wadley seconded the motion. The motion passed unanimously by voice vote. <br />
