Planning & Zoning Commission/ <br />Local Planning Agency <br />June 12, 2013 <br />Page 5 <br />2. All sales and consumption of alcoholic beverages shall be on -site and indoors. <br />3. Package sales of alcoholic beverages for off -site consumption are prohibited. <br />4. Sale of alcoholic beverages shall not exceed 49% of total revenue. <br />5. The hours of alcohol sales must be within business hours and shall comply with the hours set forth in <br />Section 10 -2 of the City of Casselberry Code. <br />6. Any sale of alcohol within the boundaries of the property must adhere to Chapter 10 'Alcoholic <br />Beverages' of the City of Casselberry Code and obtain the appropriate permits and licenses from <br />required governmental bodies. <br />7. The business shall remain in complete compliance with all City, County and State requirements. <br />8. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />9. The business owner shall provide the City with written authorization from the property owner of 922 <br />State Road 436 prior to the sale of alcohol. <br />10. The conditional use shall commence within 90 days of the approval. <br />11. The conditional use shall expire if the use is discontinued for more than 90 days. <br />12. The change of use to anything other than an art studio shall require additional conditional use approval <br />for the sale of alcohol sales. <br />13. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />Mr. Meadows asked the applicant to come forward. Mr. Scott Pantke and Ms. Nicole Pantke, 2103 Cochise <br />Trail, Casselberry, Florida came forward. In response to the Commission's question regarding the nature of the <br />business, Mr. Pantke said that it is a canvas and wine studio. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Meadows asked for a motion for CU 13 -07. Mr. Bryan made a motion that the Planning and Zoning <br />Commission approve Blast Studio (CU 13 -07) to allow the sale and on -site consumption of alcoholic beverages as <br />allowed by the 2COP state license, in conjunction with the operation of Blast Studios located at 922 State Road 436 <br />based on the findings of fact and conclusions of the staff report dated June 12, 2013 and the 13 conditions outlined in <br />the staff report. Mr. Wadley seconded the motion. The motion passed unanimously by voice vote. <br />Ninth Item of Business: BA 13 -04 1414 E. Altamonte Drive /McDonalds. Variance request to Article XVI, <br />Section 3 -16.3 "On- Premises Permanent Sign Regulations" of the Casselberry Unified Land Development <br />Regulations to allow a 38.5 foot high ground sign in lieu of the maximum ground sing height of 15 feet <br />allowed by City's Code regulations. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated June 12, 2013, <br />to the City of Casselberry Planning and Zoning Commission (a copy is file in the Community Development <br />Department). Mr. Sorensen presented a PowerPoint presentation (a copy is attached and made a part of the <br />minutes). <br />
