He said there is no trade off of land between the City and the developers. <br />In response to the Commission's question regarding the impact to the retention pond, Mr. Taylor said there would be <br />no impact. A brief discussion ensued regarding the existing retention pond, the design of the retention pond, the purchase of <br />the parcels of land from St. Augustine Church and the rezoning of the parcels. <br />Mr. Hale asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. <br />Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward. Mr. Fraleigh said the reason for height restrictions <br />of 2 stories was to create uniformity in the City. Mr. Fraleigh expressed a concern regarding the view for the residents that live <br />across the lake looking at a 6 story building. Mr. Fraleigh suggested the site could be developed with a maximum of 3 stories. <br />Mr. Fraleigh said there is going to be a park developed next to a drainage ditch and selling it as anything but a <br />drainage ditch is ridiculous. <br />Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry questioned <br />the ownership of the retention pond and the proposed development of the park. Mr. Sorensen explained that the proposal is <br />to use the existing retention pond for the retention for the project and to also provide a park area. Mr. Casselberry didn't feel <br />that the two parcels should be incorporated. He felt that the desirability was to get public access to the lake. He said most of <br />the property owners do not want public access to the lake. He suggested modifying it to be a more useable lakeshore. <br />Mr. Hale asked for final comments from staff and the applicant. Mr. Sorensen said that the Commission has several <br />options for approval and the Commission could place modifications on the project. <br />A general discussion ensued regarding the height of the building and public access to the lake. <br />Mr. Hale asked for a motion to address SPR 13 -07. Mr. Wadley said with respect to SPR 13 -07 he moved that the <br />Planning and Zoning Commission recommend approval of the applicant's conceptual plan to construct an assisted living <br />facility up to 6 stories and a playground park that will require a rezoning, future land use amendment, site plan approval and a <br />final plat.
