CASSELBERRY CITY COMMISSION <br />Minutes of January 13, 2014 — Regular Meeting <br />Page 19 of 22 <br />stressed that this would not eliminate the fees, but would merely defer them from the beginning of construction <br />to the end. She added that this would be helpful to developers, especially for large projects, because it would <br />free up funds which could be utilized in the project and not paid out on the front end of the project. She <br />clarified that this ordinance did not affect impact fees, but strictly connection fees. <br />Discussion: A brief discussion ensued during which Ms. Smith advised that the length of time between <br />issuance of a building permit and a certificate of occupancy would depend upon the size ofthe project, and that <br />the City would not be losing money; the fees would simply be paid at the end rather than the beginning of <br />construction. Ms. Reischmann also clarified that each request for a deferral would require a deferral agreement <br />which would then be considered on a case -by -case basis by the City Commission; it would not be an automatic, <br />self - executing deferral of the fees. Mr. Newlon added that the deferral of the fees would constitute a lien <br />against the property in favor of the City until paid, and that he had received information about some positive <br />attention the proposed ordinance had generated with the local realtor association. <br />Budget Impact: There is no impact to the City budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Ordinance 13 -1403 on first reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 14 -1403. The following <br />individuals came forward: <br />1. Mr. James Fraleigh, 23 Teresa Court, expressed concerns about the possibility of developers' <br />abuse of the program, and also possible financial failure of a project, either of which could <br />result in the City never receiving the fees which were due. <br />2. Mi °, John Casselberly, 700 South Lost Lake Lane, expressed some concerns about the possible <br />risk to the City in the event of any type of moratorium on capacity and suggested that any <br />agreement should have language placing such a risk on the developer and not the City. <br />No one else came forward, Mayor Glancy closed the public hearing relative to Ordinance 14 -1403. <br />MOTION: Commissioner Aramendia moved to adopt Ordinance 14 -1403 on second and <br />final reading, as presented. Motion was seconded by Vice Mayor Hufford. <br />Discussion: Vice Mayor Hufford commented that although there could possibly be abuses, this deferment of <br />fees would be an economic tool that would be an incentive for developers to develop within the City, which <br />would provide additional ad valorem taxes and revenues to the City. She noted that it would be used for larger <br />projects and not just building or renovating a single home, and would be granted on a case -by -case basis <br />meaning that not everyone who applied would receive the deferment. <br />Motion carried unanimously by voice vote 5 -0. <br />
