CASSELBERRY CITY COMMISSION <br />Minutes of December 9, 2013 — Regular Meeting <br />Page 16 of 24 <br />be added to the duties of a magistrate if the City chose to use that option. <br />Mr. James Fraleigh, 23 Teresa Court, voiced concerns about whether using a special <br />magistrate for code enforcement proceedings would actually result in any cost savings. He <br />also expressed that he felt using residents for the Code Enforcement Board would give a <br />much stronger sense of community than using an attorney as a special magistrate. <br />Mayor Glancy passed the gavel to Vice Mayor Hr fford and left the Commission Chambers at 5:58p. in. <br />Mayor Glancy returned to the Chambers at 6: 01 p. m. <br />No one else came forward. <br />MOTION: Commissioner Solomon moved to approve Ordinance 13 -1400 on first reading, <br />as presented. Motion was seconded by Commissioner Aramendia. <br />Discussion: Additional discussion ensued regarding clarification that the ordinance only added the option for <br />a Special Magistrate into the Code, but also provided for utilizing a Code Enforcement Board if in the future it <br />was determined the Special Magistrate option was not working as well as anticipated. There was also <br />discussion regarding the possibility of increased compliance; qualifications of the Special Magistrate; <br />monitoring of the success of utilizing the Special Magistrate and reporting back to the Commission for <br />evaluation of the program; and continuity of the appeals process. <br />Motion carried unanimously by voice vote 5 -0. <br />B. Ordinance 13 -1401— Amendment to the Official Zoning Map for Properties Located <br />at 1815 SR 436 (ZB 13 -02) <br />The City Clerk read Ordinance 13 -1401 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF <br />CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN ARTICLE IV, SECTION 2 -4.3, <br />UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF CASSELBERRY, <br />FLORIDA, AS AMENDED AND SUPPLEMENTED; ESTABLISHING THE ZONING <br />CLASSIFICATION OF "PMX -MID" (PLANNED MIXED USE: MEDIUM -RISE) FOR THE <br />PARCELS DESCRIBED IN SECTION 1 OF THIS ORDINANCE; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Presentation: Community Development Director Sandra Smith gave a brief overview of the item, stating that <br />this was a request for rezoning of five properties owned by Aloma Baptist Church to Planned Mixed Use — <br />Medium Rise (PMX -MID). She added that the properties included two existing properties owned by Aloma <br />Baptist Church in addition to three new properties which the church had acquired for the purpose of <br />constructing a fellowship hall adjacent to the existing facility. <br />Ms. Smith explained that the church would have to go through conditional use approval, plat and site plan <br />approval in addition to the rezoning, and that the rezoning was necessary to correspond with the existing <br />Future Land Use of Major Thoroughfare Mixed Use (MTMU).
