CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />AUGUST 8, 2013 <br />Kevin Champagne, District Manager for Circle K stores gave testimony. Mr. Champagne advised that an <br />initial plan went to the Zoning Board and was denied, they are waiting on a second plan. They are ready to <br />go and just waiting on the approval. Circle K was not the property owner when this violation began. <br />MOTION: Mr. Bakalla moved to find Respondents in this case in violation of the City Code as charged <br />and that Respondents correct the violation before 1:00 p.m. on 10/09/2013. In the event Respondent does <br />not comply by this date, a fine in the amount of $250.00 per day will be imposed for each day the <br />violation continues past the aforestated date. The Respondents are further ordered to contact the Code <br />Compliance Officer to verify compliance with this Order. Mr. Lutz seconded the motion. The motion <br />passed unanimously. <br />CE -13 -00513 Damaged Windows, skylights, doors, (1994)SBCCI 305.7- 305.13.2 <br />CE -13 -00557 Swimming pool standards, ULDR Section 3 -10 <br />• 1207 Quintuplet Ct <br />Officer Hull gave testimony for the above cases. <br />Susan Amell, 1203 Quintuplet Ct, gave testimony for the above cases. Ms. Amell stated she was <br />probably the one who put in the majority of the complaints. Ms. Amell stated she was present last <br />October 14th before the Board and addressed many of the same issues. The photographs just <br />submitted were taken on August 3rd 2013, later that day a lawn maintenance company was mowing a <br />portion of the lawn. <br />MOTION: Mr. Smith moved to find Respondents in this case in violation of the City Code as charged <br />and that Respondents correct the violation before 1:00 p.m. on 08/22/2013. In the event Respondent does <br />not comply by this date, a fine in the amount of $100.00 per violation per day will be imposed for each <br />day the violation continues past the aforestated date. The Respondents are further ordered to contact the <br />Code Compliance Officer to verify compliance with this Order. I find that the violations constitute a <br />serious threat to the public health, safety and welfare and in the event the Respondent does not correct the <br />violation by the date set in this order, the city commission shall be notified and appropriate action should <br />be taken by the City to bring the property into compliance. The City is entitled to recover its reasonable <br />costs of such services. Mr. Herron seconded the motion. The motion passed unanimously. <br />Overp,rown/trash and debris, ULDR Section3- 10.3.(C)(i)- repeat violation <br />• CE -13 -00611 675 San Pablo Ave <br />Officer Hull gave testimony for the above case. This property was in violation for 1 day, July 2, <br />2013 and is a repeat violation based on a standing order. The City requests a $50.00 per day fine. <br />Gary Patrick, father of the property owner was present to speak on his sons behalf. Mr. Patrick stated <br />his son has hired a lawn service. The property is currently in compliance. <br />MOTION: Mr. Lutz moved to find Respondent in this case was in repeat violation of City Code as <br />charged based on the Board's prior order entered against the same Respondent for the same violation. The <br />Respondent brought the property into compliance on 07/03/2013. A fine in the amount of $50.00 is hereby <br />imposed for 1 (day) of repeat violation. Mr. Bakalla seconded the motion. The motion passed <br />unanimously. <br />
