CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />AUGUST 8, 2013 <br />Officer Hull advised the Code Board that the above case was in compliance by the date set by the Board <br />and no fine should be imposed. <br />MOTION: Mr. Smith moved to find that Respondents in this case have complied with the Board's prior <br />order by the date specified in that Order and no fine will be imposed. Mr. Herron seconded the motion. <br />The motion passed unanimously. <br />REDUCTION REQUEST <br />CE -10 -01552 Placement of material, machinery, or temporary soil deposits, ULDR Section 3- 10.9.A <br />CE -10 -01553 Dead tree(s), ULDR Section 3 -10.3 (C) (1) <br />CE -10 -01554 Hot and cold water supply, City Code Section 86 -162 <br />• 141 Sunnytown Rd <br />Officer Hull, advised the Code Board that the property owner was asking for a reduction of the lien. The <br />City recommends a 75% reduction to $11,675 for the first two cases and $850 for the third case to cover <br />administrative cost. There is also a $1,560 lien that is required to be paid for dead tree removal as a hard <br />cost. There is a pending sale on this property and a respondent was present to speak. <br />Paul Ginzl, real estate broker with ReMax Town and Country. The property owner is Fannie Mae, and Mr. <br />Ginzl is the agent assigned to the property. The property was taken back at a foreclosure sale on February <br />7, 2013; it was assigned the next day. <br />MOTION: Mr. Herron moved that the Board recommend to the City Commission that the lien will be <br />reduced in this case from $91,350 to $ 12,525, to be paid within 60 days of the commission's order or the <br />fine reverts to the original fine amount. The reason for this reduction is the original owner had hardships <br />and couldn't keep up with the house, and home was also in foreclosure. <br />CASE WITHDRAWN <br />Business tax receipt, City Code Section 26.33 <br />• CE -13 -00575 1624 Excalibur Dr <br />Unsecured structure, City Code Section, 1 -4.1 which adopts FFPC 10.13.1 <br />• CE -13 -00618 1259 SR 436 <br />Officer Hull advised that the above cases were being withdrawn due to compliance. <br />NEW CASES <br />Pruning tgpping of trees, ULDR Section 3- 14.9(F) <br />• CE -13 -00127 1515 SR 436 <br />Officer Hull gave testimony for the above case. Mr. Hull advised this business is the Circle K store. <br />Jason Sorensen, Planner I for the City of Casselberry, gave testimony. Mr. Sorensen read Article 14 of the <br />Tree Protection Code. This matter will be heard by the Planning and Zoning Board the week after this <br />meeting, the applicants' remediation plan will be reviewed at this time. If the plan meets the code the City <br />would set a 45 day limit on the restoration of the property, they would have that time to replant the trees. <br />
