CASSELBERRY CITY COMMISSION <br />Minutes of April 8, 2013 — .Regular Meeting <br />Page 13 of 17 <br />MOTION: Commissioner Aramendia moved to deny the request for reduction of the lien <br />in Case Number CE- 12- 00725. Motion was seconded by Commissioner <br />Hufford. Motion carried unanimously by voice vote 5 — 0. <br />E. Request for Reduction of Code Enforcement Lien — 219 Lake Ellen Drive <br />Staff Presentation: Sandra Smith, Interim Community Development Director, advised that this was a <br />violation due to trash and debris and an accumulation of dead tree limbs out by the side of the road. She stated <br />that the property was in violation for 76 days with a fine of $150 per day for the violation. She explained that <br />the title company had applied for a reduction of the lien, but did not have a representative present at the Code <br />Enforcement Board meeting when the reduction was being considered. She further explained that, based on <br />the fact that no one had attended the meeting for the applicant, and the applicant was the title company rather <br />than the property owner, the Code Enforcement Board had voted to recommend that the Commission deny the <br />request for a reduction of the lien. In response to questions from Mayor Glancy, Ms. Smith advised there was <br />no indication in the application that there was a sale pending on the property, and no one had attended the <br />meeting to speak on the issue. <br />No one came forward to address this item. <br />MOTION: Commissioner Aramendia moved to denv the request for reduction of the lien <br />in Case Number CE -12- 01152. Motion was seconded by Commissioner <br />Hufford. Motion carried unanimously by voice vote 5 — 0. <br />A. Future Agenda Items <br />Commissioner Hufford expressed concerns about the proliferation of clothing receptacles placed randomly in <br />commercial areas, which she stated was a violation of the City's Code. <br />Discussion: Discussion ensued regarding the organizations placing the receptacles and what measures could <br />be taken to get them removed. Mr. Newlon advised he would refer the matter to Code Enforcement and try to <br />get additional information which be would pass along to the Commission. There was additional discussion <br />about whether the City could remove and store them and then notify the owner about where it could be picked <br />up. Commissioner Aramendia suggested that it should probably go through a process of notification to the <br />owner with a time given to remove it, as with any code violation. Ms. Reischmann confirmed that would be <br />the proper way to handle it, as the City was only authorized to go onto private property to correct a violation if <br />there was a public nuisance or safety hazard. <br />
